A new class action lawsuit alleges Lunazul tequila is falsely advertised as being made from 100% Blue Weber agave.
Plaintiff Joel Sylvain filed the class action complaint against Heaven Hill Distilleries on Nov. 10, 2025, in Florida federal court, alleging violations of state and federal consumer laws.
According to the class action lawsuit, Heaven Hill falsely markets its Lunazul tequila as being made from 100% Blue Weber agave, when in reality, it contains ethanol derived from non-agave sources.
Sylvain says the company’s marketing and labeling practices deceive consumers into paying premium prices for what they believe is authentic, high-quality tequila.
He says the Lunazul brand includes several varieties of tequila, all of which claim to be made from 100% Blue Weber agave and are priced between $23.98 and $43.99 per bottle.
Plaintiff: Lunazul tequila contains ethanol from non-agave sources
Sylvain claims he commissioned specialized testing of the Lunazul products, which revealed they contain significant amounts of ethanol not derived from agave plants.
He says this contradicts Heaven Hill’s marketing claims and violates both Mexican and U.S. regulations for tequila production.
The class action lawsuit argues that consumers pay a premium for tequila made from 100% Blue Weber agave due to its authenticity and quality.
The Blue Weber agave takes five to 10 years to mature and must be grown in specific regions of Mexico, making it a more expensive ingredient, the lawsuit says.
Sylvain says he and other consumers relied on Heaven Hill’s representations when purchasing Lunazul tequila, believing they were buying a premium product.
He claims that had they known the truth about the product’s composition, they would have either paid less or not purchased it at all.
Sylvain is looking to represent anyone in the United States who purchased Lunazul tequila during the applicable statute of limitations period. He is suing for negligence, negligent misrepresentation, unjust enrichment and violations of Florida consumer laws and is seeking certification of the class action, damages, fees, costs and a jury trial.
Similarly, a consumer filed a class action lawsuit against Costco, alleging it falsely advertised its Kirkland Signature-brand tequila as being made from 100% blue agave when it allegedly contained ethanol from other sources.
