Liquid IV Hydration Powder Packages Energy Drink Flavoring on Shelf at Store

Liquid I.V. class action lawsuit overview:

  • Who: Plaintiff Jessica Argueta filed a class action lawsuit against Unilever United States Inc., doing business as Liquid I.V.
  • Why: Argueta claims Unilever misleads consumers into believing its Liquid I.V. Lemon Lime Electrolyte Drink Mix packets are full when they are allegedly half-empty.
  • Where: The Liquid I.V. class action lawsuit was filed in California federal court.

A new class action lawsuit claims Unilever United States sells its Liquid I.V. Lemon Lime Electrolyte Drink Mix in packets that are half-empty.

Plaintiff Jessica Argueta claims Unilever misleads consumers into believing they are getting more product than what is actually in the packets.

Argueta wants to represent a California class of consumers who purchased Liquid I.V. Lemon Lime Electrolyte Drink Mix for personal use since September 2021.

Argueta claims Unilever’s packaging violates California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.

“Plaintiff and consumers have, accordingly, suffered injury in fact caused by the false, unfair, deceptive, unlawful and misleading practices set forth herein and seek injunctive relief as well as, inter alia, compensatory damages, statutory damages, restitution and attorneys’ fees,” the Liquid I.V. class action lawsuit states.

Liquid I.V. class action claims drink mix packets contain slack-fill

Argueta claims Unilever sells its Liquid I.V. Lemon Lime Electrolyte Drink Mix in oversized packaging that does not reasonably inform consumers that they are over half-empty.

“Defendant underfills the Product to save money (by not filling the containers) and to deceive consumers into purchasing the Product over its competitors’ products,” the Liquid I.V. class action lawsuit alleges.

Argueta claims the drink mix packets contain nonfunctional slack-fill, which is the empty space in a package that is filled to less than its capacity for illegitimate or unlawful reasons.

“Defendant’s packaging of the Product was a material factor in Plaintiff’s and the Class’s decisions to purchase the Product,” the Liquid I.V. class action lawsuit states. “Based on Defendant’s packaging of the Product, Plaintiff and the Class reasonably believed that they were getting more product than they actually received.”

Argueta claims she would not have purchased the drink mix packets had she known they were half-empty.

Similarly, PepsiCo recently faced a class action lawsuit accusing the company of using oversized packaging that fails to reasonably inform consumers the products are more than half empty.
