unum-lawsuit-denialClaiming Unum Life Insurance Company wrongfully denied her long-term disability benefits, a North Carolina resident filed a Unum lawsuit

After exhausting all her administrative appeals to the insurance provider, Kimberly S. filed the Unum lawsuit, accusing Unum of breaching its obligations under ERISA, asking for declaratory relief, reinstatement of her long-term disability benefits and reimbursement for her attorneys’ fees.

According to the Unum lawsuit, Kimberly, a former Creative Director at Intermedia Advertising Group, was diagnosed with multiple sclerosis and ceased working in June 2004 when her condition left her unable to fulfill the physical demands of her position.

Kimberly initially received long-term disability benefits from Unum for a period of 10 years, providing regular medical updates to the insurance company about her multiple sclerosis. However, in 2014, Unum claimed she was no longer disabled and terminated her disability benefits.

Unum Denied Disability Claims

Unum, formerly known as Paul Revere, Provident, and then Unum Provident, is the world’s largest disability insurance provider. Unfortunately, UNUM has also gained a notorious reputation for denying qualified claims for long-term disability benefits.

Among tactics allegedly used by Unum to unreasonably delay or deny disability insurance claims:

  • Arguing the policyholder had a pre-existing condition, even if that condition is not linked to the one being claimed
  • Refusing to acknowledge certain disabilities
  • Ignoring professional medical diagnosis or using biased experts
  • Changing policies after a claim is filed
  • Claiming a person is not disabled and can work, despite a medical diagnosis from a professional

Such tactics listed above fall under bad faith insurance, and if an insurer has committed bad faith insurance, policyholders whose claims have been improperly or unreasonable denied or delayed may be eligible to file a complaint against the insurance company.

Unum Lawsuits

Many Unum lawsuits stem from denial of legitimate Unum long-term disability insurance claims in which the insurance company allegedly fails to compensate the insured for a loss covered by their policy, or unreasonably delays making payments due under the policy.
