Top Class Actions viewers report receiving settlement checks from a FoodState supplement class action settlement as well as a Wells Fargo telemarketing class action settlement.

FoodState Supplements Class Action Settlement

According to Top Class Actions viewers, Class Members in the FoodState supplements class action settlement are receiving checks worth as much as $24.20.

Class Members eligible for settlement checks included customers who purchased certain FoodState supplements between Jan. 14, 2011 and Sept. 15, 2018. Among those covered supplements were MegaFoods and Innate Response Formula brand supplements.

FoodState agreed to pay $2.1 million in settlement money to end claims that the company falsely advertised its supplements.

The consumers claimed that the company falsely inflated the amount of nutrients from “whole foods” than were really present in the supplements.

Additionally, the customers argued that there were some ingredients in the supplements that were not disclosed at all, including magnesium stearate.

The plaintiffs explain that magnesium stearate is present in some foods, but because it can irritate the bowels of some individuals, FoodState should have disclosed its presence.

Customers argued that they were financially injured by FoodState’s misrepresentations because had they known that the supplements contained fewer “whole food” nutrients and magnesium stearate, they would not have purchased the supplements or would not have paid as much as they did for them.

The deadline to file a claim for settlement money was Aug. 19, 2019.

The Class Members were represented by the Kazerouni Law Group APC and Hyde & Swigart.

The FoodState Supplements Class Action Lawsuit is Bauman, et al. v. FoodState Inc., Case No. 1:17-cv-00637-LM, in the U.S. District Court for the District of New Hampshire.

Wells Fargo Unwanted Calls, Texts Class Action Settlement

Top Class Actions viewers are also receiving Wells Fargo spam call and text settlement checks worth as much as $436.40.

Class Members eligible for settlement money include those individuals who received various automated phone calls or text messages from Wells Fargo between Jan. 13, 2013 and July 10, 2019, even though they were not customers at the bank.

A range of calls were included in the TCPA class action settlement, and each kind of call was associated with a different date range to be included in the Class.

Wells Fargo paid $17.85 million in settlement money to escape multiple TCPA class action lawsuits. Consumers across the country had launched their claims against Wells Fargo beginning in 2017, saying the bank called and texted consumers without their consent in violation of the Telephone Consumer Protection Act.

The customers stated that the Telephone Consumer Protection Act prohibits businesses from calling or texting consumers with automatic dialing systems or sending them prerecorded messages without consumers’ consent.

The Wells Fargo TCPA class action lawsuits asserted that the calls and messages concerned credit card accounts, mortgages, auto loans, credit card accounts, and overdrafts. In some cases, these messages were sent to people who were not customers of Wells Fargo, claim the plaintiffs.

In the eyes of the call recipients, Wells Fargo put potential profits ahead of consumer privacy and the law. The customers argued that the company was aware or should have been aware of the TCPA’s restrictions, but violated the law nonetheless.

Wells Fargo denied any wrongdoing, but agreed to end the multiple TCPA class action lawsuits in a settlement to avoid the costs and risks of continuing to litigate the issue.

The deadline to file a claim was Dec. 23, 2019.
