A plaintiff has filed a new Denali IVC Filter lawsuit on behalf of a deceased individual who allegedly suffered severe complications associated with this IVC filter.
The defendant is C.R. Bard, manufacturer of the Denali IVC Filter. The Denali IVC Filter lawsuit was filed on multiple counts against the defendant, including breach of express warranty, design negligence, manufacturing negligence, manufacturing defects, breach of implied warranty, fraudulent misrepresentation, strict product liability for design defects and fraudulent concealment.
The Denali IVC Filter lawsuit is seeking punitive damages and all due compensation on behalf of the deceased individual who suffered catastrophic injuries as a result of the Denali IVC Filter. Unfortunately, there are a growing number of consumers coming forward to file a lawsuit associated with the Denali IVC Filter, either for themselves after sustaining personal injuries or on behalf of loved ones who suffered fatal injuries.
The Denali IVC Filter is a blood clot filter that is arranged in a cone-like shape. There are 12 wire legs, shaped like needles, referred to as struts, and this device is implanted into a patient’s inferior vena cava to capture blood clots from the lower portion of the body.
The primary purpose of the Denali IVC Filter is similar to other devices in this category and that is to prevent pulmonary embolisms. The Journal of Vascular Interventional Radiology captured a case report in January 2015 noting problems associated with severe injuries tied to a Bard Denali IVC Filter. Six months after that filter was implanted, the woman had to go back to the hospital to have it removed.
A growing number of individual lawsuits have been filed over the Bard Denali IVC Filter since then. A class action lawsuit was lodged in May 2016 on behalf of everyone who was affected by the Denali IVC Filter, including those who have not yet been injured.
A Class 2 recall was issued by Bard for more than 1100 Denali IVC Filters in February 2016. The primary purpose of this recall was to correct a labelling issue, since there were no warnings against uncontrolled sepsis or those patients who may have nickel-titanium allergy.
The FDA also issued a safety warning associated with the Bard Denali IVC Filter in 2010 after receiving more than 900 adverse event reports associated with the filter since 2005. Some of the most common filter complications include tilting, cardiac arrest, fracture, organ damage, embolization of broken pieces to the heart, movement inside the body, ventricular tachycardia, and death.
No one should have to suffer the consequences of dealing with severe injuries or the loss of a loved one because of an IVC filter, but this has become a reality for many families. Many of them argue that the manufacturer should have warned them about the dangers.
The Denali IVC Filter Lawsuit is Case 2:18-CV-01178-DGC, filed in the United States District Court for the District of Arizona.
