A new class action alleges Hello Products LLC’s toothpaste contains dangerous levels of heavy metals, including lead and mercury.
Plaintiff Damany Browne filed the class action complaint against Hello Products on July 11 in New York federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, Hello Products sells its Hello Toothpaste without warning consumers that it contains dangerous levels of heavy metals like lead and mercury.
The lawsuit claims lead and mercury are avoidable constituents in Hello Products’ toothpaste and its manufacturing process, and that the company knew or should have known about the risk of heavy metal contamination before selling its products to consumers.
Despite this knowledge, Hello Products failed to warn consumers about the potential presence of heavy metals on its packaging or in its marketing materials, Browne says. As a result, consumers were led to believe that the Hello Toothpaste was safe, healthy and free of harmful substances, he claims.
Independent testing revealed high levels of lead and mercury in Hello Toothpaste, lawsuit claims
The lawsuit references a recent study by consumer safety organization Lead Safe Mama, which tested various toothpastes, including Hello Products’ Hello Kids Dragon Dazzle Toothpaste and Hello Kids Fluoride Free Toothpaste Fresh Watermelon.
The study found Hello Kids Fluoride Free Toothpaste tested for 493 parts per billion (ppb) of lead and 19 ppb of mercury, while the Hello Kids Dragon Dazzle Fluoride Toothpaste tested for 428.4 ppb of lead and 11.8 ppb of mercury.
These levels far exceed the U.S. Environmental Protection Agency’s maximum contaminant levels for drinking water, which are set at 15 ppb for lead and 2 ppb for mercury, Browne claims.
The lawsuit alleges Hello Products’ failure to disclose the presence of heavy metals in its Hello Toothpaste is particularly concerning because toothpaste is used daily and can be absorbed or ingested into the bloodstream.
Browne is looking to represent anyone in New York who purchased Hello Products’ Hello Toothpaste. He is suing for breach of warranty and violations of New York’s consumer protection laws and seeks certification of the class action, damages, fees, costs and a jury trial.

My soon to be seven-year-old baby girl has been using Hello and Toms of Maine Toothpaste for several years. My wife and I cannot understand why our daughter keeps getting canker sores; even her dentist cannot figure it out. I am beyond angry! We are going to have her blood tested.
