Another patient who got a Xarelto prescription thinking that it would help with health issues and not create more is the latest to lodge a lawsuit. The legal claim says that the makers of the drug fell short due to their failure to warn about the high risk of Xarelto hemorrhage.
Plaintiff Debra L. has initiated a Xarelto lawsuit against Janssen Research and Development and parent company Johnson & Johnson. The Xarelto hemorrhage lawsuit says that Xarelto is a defective medication that is promoted as safe for reducing the risk of systemic embolism and stroke.
Xarelto is also often prescribed to treat deep vein thrombosis and for prophylaxis of DVT for those patients undergoing knee or hip replacement surgery. However, according to the Xarelto hemorrhage lawsuit, the defendants fraudulently or negligently represented to the health care and medical community that the blood thinner was safe.
Debra’s Xarelto hemorrhage lawsuit says that the defendants went so far as to conceal their knowledge about Xarelto’s defects from the FDA and from the medical community, putting patients at risk. Her lawsuit also says that the defendants improperly and negligently failed to perform appropriate tests that would have revealed the significant consequences and side effects.
Plaintiff Complaints
The Xarelto hemorrhage lawsuit says that the plaintiff suffered an irreversible and life-threatening bleed as a result of the use of Xarelto being prescribed.
The plaintiff in the Xarelto hemorrhage lawsuit says that she was prescribed the medication in July 2014 for the treatment of deep vein thrombosis (DVT). Debra says she continued her Xarelto use from July 2014 through January 2017.
However, she alleges she suffered a Xarelto hemorrhage, a risk she says she was not properly warned about before she decided to take the medication. The injured woman says that she experienced a lower gastrointestinal hemorrhage in January 2015.
The lawsuit goes on to argue that the manufacturer is responsible for failing to warn about the serious risks of Xarelto hemorrhage and the resulting costs and injuries from pain and suffering, associated medical conditions and emotional distress.
Debra says that the drug is marketed and distributed as a safe oral anticoagulant, despite the fact that it comes with significant risk of hemorrhage. A life-threatening bleed could develop quickly, she says, and a patient who is not aware of how to respond to this might not be able to get medical attention fast enough to abate the issues. She alleges the development of a Xarelto hemorrhage event could become life-threatening and lead to long-lasting medical consequences.
The plaintiff says that the manufacturers knew about the risks associated with Xarelto bleeds, but failed to include these in their clinical trials, materials submitted to the Food and Drug Administration or on the drug label directly. Debra argues that this has put her and numerous other users of Xarelto, who expected it to help them with their medical conditions, at risk of developing a life-threatening bleed event.
Debra’s Xarelto Hemorrhage Lawsuit is Case No. 2:18-cv-09587-EEF-MBM, filed in the US District Court, Eastern District of Louisiana.
