If you or a loved one were present inside the concert gates at the Oct. 1, 2017 Las Vegas shooting at the Mandalay Bay Resort, you may have a legal claim.
In the mass shooting that occurred at the Route 91 Harvest music festival last fall, 58 people were killed, 546 people were injured. Many others suffer PTSD as a result of witnessing the horrific event.
In the wake of the event, Las Vegas shooting survivors and victims’ families were left to deal with trauma in the wake of the tragedy, as well as other hardships including medical bills and financial hardship due to missed work. To date, many victims and families have received compensation for financial, emotional, and physical injury from state-run programs that provide victims of crimes with compensation.
The Las Vegas Victims Fund, a non-profit fund set up to distribute almost $22 million donated in the wake of the shooting, is still taking claims by Las Vegas shooting survivors. However, many victims experiencing PTSD and trauma say they had their claims for compensation rejected because they were determined to be “not injured enough.”
If are a Las Vegas shooting survivor, you deserve compensation for emotional, physical, and financial injury. A Las Vegas shooting lawyer can help you determine what you may be entitled to, and can help advocate for you to get the compensation you deserve. Even if you were not physically injured, you may have a legal claim.
Las Vegas Shooting Survivors Turn to Litigation
Victims are already using legal recourse to help them receive compensation. To date, at least 450 victims are being or have been represented in Las Vegas shooting lawsuits.
Las Vegas shooting survivors have filed lawsuits accusing MGM Resorts International, the owner of Mandalay Bay Resorts, and Live Nation, the host of the Route 91 Harvest Music Festival, for negligence. Lawsuits have also been filed against the shooter’s estate, making claims of assault, battery, and intentional affliction of emotional distress.
MGM has been accused of the following:
- Not having adequate security policies in place
- Not properly training its staff
- Not properly surveilling the premises for security purposes
- Responding too slowly after security guard Jesus Campos was shot.
- Being negligent in giving the shooter access to a service elevator at the Mandalay Bay Resort, thus enabling him to transport weapons and ammunition in the days preceding the shooting
Live Nation has been accused of the following:
- Failing to provide enough exits at the music festival
- Insufficiently training employees on emergency protocol
- Failing to use loudspeakers, video monitors, or media boards at the venue to broadcast evacuation instructions in the wake of the shooting, leading to more injuries than would have otherwise occurred
Las Vegas shooting survivors who file a civil lawsuit can receive compensation for a number of factors, including personal injury; pain and suffering; disability; lost earnings due to injury and missed work; past, present, and future medical expenses, or counseling for mental health services.
