Lands’ End class action lawsuit overview:

A new Lands’ End class action lawsuit accuses the retailer of misleading consumers into believing they are receiving a discount on its clothing products.

Plaintiff Madison Meadows claims Lands’ End advertises discounts on its products that are constantly available and not actually discounts off the true regular price.

Meadows seeks to represent a Washington class of consumers who purchased discounted Lands’ End products on the company’s website and/or received promotional emails from Lands’ End advertising sales or discounts.

“Defendant’s advertisements harm consumers by inducing them to make purchases based on the false belief that they are getting a substantial discount,” the Lands’ End class action lawsuit says.

Meadows argues Lands’ End’s alleged fake discounts artificially increase consumer demand for its products, which she claims in turn puts upward pressure on the prices that the retailer can charge.

As a result, Meadows claims Lands’ End is able to artificially sell more products and charge an artificial price premium attributable to its use of fake discounts.

Lands’ End allegedly violates consumer protection law

Meadows argues Lands’ End is guilty of breach of contract and express warranty, unjust enrichment and intentional and negligent misrepresentation and of violating the Washington Consumer Protection Act and Washington’s Commercial Electronic Mail Act.

She demands a jury trial and requests declaratory and injunctive relief and an award of actual, statutory, treble and/or punitive damages for herself and all class members.

Similarly, Nordstrom was recently sued for allegedly sending emails that falsely advertised discounts for its Nordstrom Rack brand.
