Landry’s Restaurants, Inc. has reached a class action lawsuit settlement concerning gift card fees. If you’re a New Jersey resident and purchased a Landry’s gift card on or after April 4, 2006 with a dormancy fee provision, you may be entitled to a $100 gift certificate.
The Landry’s Restaurants gift card settlement will resolve a class action lawsuit, entitled Delany v. Landry’s Restaurants, Inc., that alleges Landry’s sold gift cards in New Jersey containing a dormancy fee and other provisions that allegedly violate the New Jersey Truth in Consumer Contract Warranty and Notice Act and the New Jersey Gift Card Act.
As part of the Landry’s gift card class action settlement, Landry’s has agreed to continue to honor the full value of unredeemed or the remaining value of partially redeemed Landry’s gift cards sold in New Jersey after April 4, 2006. It no longer sells gift cards containing a dormancy fee provision.
If you purchased a Landry’s gift card on or after April 4, 2006 that had a dormancy fee provision, you may be entitled to a Landry’s gift certificate in the amount of $100. This certificate is in addition to any amount remaining on your gift card. In order to obtain this gift certificate, you must present proof of purchase in the form of the actual gift card, the purchase receipt, or a credit card statement showing that you purchased the gift card. If you cannot show proof of purchase, you may be entitled to a gift certificate in a lesser amount, provided you submit an affidavit attesting that you purchased the gift card.
To claim your gift certificate from the Landry’s class action lawsuit settlement, you must submit a pre-printed claim form along with the required documentation no later than February 15, 2011. To obtain a claim form, call 718-386-7014.
