A new class action lawsuit alleges Kraft Heinz falsely advertises its macaroni and cheese product as containing “no preservatives” when it actually contains citric acid, which functions as a preservative.

In 2024, Kraft Heinz faced a similar class action lawsuit alleging it falsely labeled its macaroni and cheese products in violation of the Missouri Merchandising Practices Act.

Plaintiff Jennifer Legrier claims the citric acid in the macaroni and cheese product functions as a preservative by preventing spoilage, extending shelf life and maintaining flavor and quality.

“Despite promising ‘no artificial preservatives,’ the ingredient list, in fine print on the side of the box, reveals ‘citric acid,’ a non-natural, synthetic ingredient, which, tends to, does and/or can, function as a preservative in this food,” the Kraft Heinz class action lawsuit states.

Legrier wants to represent a New York class of consumers who purchased the Kraft Heinz macaroni and cheese product for personal consumption or use during the applicable statute of limitations.

Kraft Heinz allegedly misleads consumers and violates state law

Legrier claims Kraft Heinz misleads consumers by labeling the macaroni and cheese product as having no preservatives and charging a premium price.

The Kraft Heinz class action lawsuit argues the company’s alleged misrepresentation violates New York’s General Business Law, which prohibits deceptive advertising and unfair business practices.

Legrier demands a jury trial and requests actual damages for herself and all class members.
