A new class action lawsuit alleges Keurig Dr Pepper misleads consumers into believing its Mott’s 100% juice products are free of synthetic ingredients.
Plaintiff Gail Gray’s class action lawsuit claims Keurig Dr Pepper markets its Mott’s 100% juice products in a “systematically misleading manner” by misrepresenting on the labels that they contained 100% juice.
Gray argues Keurig Dr Pepper reinforces the alleged misrepresentation by adding vignettes of fruits and including the claim in the title of the products.
“Unbeknownst to consumers, however, the products all share a common ingredient that belies their ‘100% Juice’ representations: ascorbic acid — a well-documented synthetic ingredient,” the Keurig Dr Pepper class action lawsuit says.
Gray wants to represent a nationwide class and New York subclass of consumers who purchased the Mott’s 100% juice products primarily for personal, family or household purposes and not for resale.
Keurig Dr Pepper ‘unjustly enriched’ by misrepresentations, class action alleges
Gray claims Keurig Dr Pepper’s alleged deceptive conduct is underscored by the fact that other fruit juice products labeled with 100% juice representations do not contain any additional non-juice ingredients.
Gray claims Keurig Dr Pepper is unjustly enriched at the expense of consumers as a result of its allegedly deceptive conduct.
The class action lawsuit raises claims for violations of state consumer protection statutes and New York General Business Law.
Gray demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for herself and all class members.
Similarly, two consumers filed a class action lawsuit against Mott’s earlier this year, claiming it falsely advertised its ReaLemon and ReaLime products as made with only natural ingredients, even though they contain artificial preservatives, such as sodium benzoate and sodium metabisulfite.
