The $4.5 million class action settlement resolves allegations that Bayer AG, and others, conspired to keep less expensive versions of Cipro from being available to Kansas consumers.

According to the class action lawsuit, the defendants violated Kansas’ antitrust and consumer protection laws by not allowing generic versions of Cipro (ciprofloxacin) on the state’s pharmaceutical market.

Bayer denied the allegations but agreed to settle the lawsuit in order to avoid the risk and cost of further litigation.

Class Members included all “persons and entities who bought the prescription antibiotic drug Cipro in Kansas between January 8, 1997 and October 31, 2004.”

The deadline to file a claim for the Kansas Cipro class action settlement passed on July 31, 2016.
