Joint Juice False Advertising Class Action Lawsuit

By Sarah Pierce

Joint JuiceA federal class action lawsuit claims Joint Juice Inc. (n/k/a Premier Nutrition Corp.) made false marketing claims about its Joint Juice liquid dietary supplement.

Lead plaintiff Harold M. Hoffman alleges in the Joint Juice class action lawsuit that Premier advertised and sold Joint Juice nationwide based on false claims about the product’s efficacy at treating osteoarthritis. These alleged false advertising claims induced consumers into believing Joint Juice could deliver cartilage repair, improve flexibility and provide relief from stiff, achy joints, the class action lawsuit says.

“Defendant took consumers’ money predicated on these specific claims of health benefits and delivered to them, in return, nothing but broken promises,” the Joint Juice class action lawsuit states.

The class action lawsuit goes on to state that the “latest valid research” regarding Glucosamine HCI – the main ingredient in Joint Juice – contradicts these advertising claims. The class action lawsuit cites a study funded by two National Institutes for Health units that found there was no significant difference in pain relief for subjects who took glucosamine and those who consumed a placebo.

“[N]o reliable clinical research supports the claims made by defendant that oral consumption of Glucosamine, the principal ingredient in Joint Juice, can lead to cartilage health and/or deliver joint benefit,” Hoffman claims in the Joint Juice class action lawsuit.

Hoffman is seeking treble damages, reimbursement and compensatory damages for a proposed class of all consumers nationwide that purchased Joint Juice in the past six years. It is alleging claims of common law fraud, knowing concealment or omission, false pretense, deception and “unconscionable commercial practice” under the New Jersey Consumer Fraud Act, and more.

On Friday, Premier removed the class action lawsuit from state to New Jersey federal court, saying the amount of damages or restitution potentially available under Hoffman’s allegations is at least $155.7 million, which exceeds the amount state court has jurisdiction over.

The Joint Juice False Advertising Class Action Lawsuit case is Hoffman v. Joint Juice, Inc., Case No. 12-cv-7630, U.S. District Court, District of New Jersey. The plaintiff, who is an attorney, is representing himself.

I drank a lot of this thinking it would help my joints by lubricating them. I drank this stuff for years and I was not any better pain wise. I did not want surgery so used this to help. I might as well have been drinking plain tap water. I just thought the more I drank the better my joints would be.This drink was expensive also so wasted money and I could have been taking something that actually would work. I finally quit buying it as it was not doing what it said it would do. Joe Montana lied about it on tv also. You think you can trust people but not anymore!
