A South Carolina jury awarded more than $63 million to an individual who argued he developed terminal lung cancer from breathing in asbestos in Johnson & Johnson talc-based baby powder.ย
Plaintiff Michael Perry argued he developed terminal mesothelioma from daily exposure to the Johnson & Johnson talc-based baby powder. The complaint also named beauty product maker American International Industries as a co-defendant.ย
The jury determined that negligence on behalf of Johnson & Johnson and AII was the โproximate causeโ of Perry developing mesothelioma, reports Law360.ย
The jury award reportedly includes more than $23 million in economic and other damages, in addition to $30 million in punitive damages to be paid by Johnson & Johnson and $760,000 to be paid by AII.ย
Perryโs spouse, Lonnie Long, was also awarded more than $9.6 million in damages for loss of consortium, reports Law360.ย
J&J found liable for selling talc-based baby powder that caused manโs cancer
In addition to negligence, the jury reportedly found Johnson & Johnson and AII were strictly liable for selling talc-based baby powder products that were the proximate cause of Perryโs injuries.ย
The jury found Johnson & Johnson and AII guilty of conduct that was โwillful, wanton or reckless,โ with the latter determined to have further engaged in โfraudulent misrepresentation in selling its products,โ that was found to be a proximate cause of Perryโs injuries, reports Law360.ย ย
Perry and Long reportedly filed their complaint against Johnson & Johnson and AII after Perryโs mesothelioma diagnosis in July 2023.ย
The complaint accused Johnson & Johnson of โintentionally and fraudulentlyโ misrepresenting that its talc-based baby powder was safe and concealing the evidence of the product containing asbestos, reports Law360.ย
In June, Johnson & Johnson agreed to pay $700 million and stop selling talc-based products in the U.S. as part of a nationwide settlement made to resolve claims it misled consumers about their safety.ย
