Listerine Naturals Mouthwash Class Action Lawsuit Overview:

  • Who: A New York City resident has filed a class action lawsuit against Johnson & Johnson Consumer Inc.
  • Why: Plaintiff claims that Johnson & Johnson’s Listerine Naturals mouthwash does not contain natural ingredients and is made using a synthetic process. 
  • Where: The class action lawsuit was filed in New York federal court. 

A class action lawsuit claims that most, if not all, of the ingredients in Listerine Naturals mouthwash are not natural as Johnson & Johnson Consumer Inc. markets them to be.

The lead plaintiff, Bobby Phillips, accuses Johnson & Johnson of fraud, negligent misrepresentation, breaching product warranty, and unjustly making profit by falsely advertising its Listerine Naturals mouthwash. 

Phillips argues that he and other New York consumers would not have bought Listerine Naturals mouthwash or paid less for it if they had more information about the ingredients. Further, Johnson & Johnson allegedly sold more Listerine Naturals mouthwash at higher prices, despite knowing that the product was worth less than what the company claimed. 

Listerine Naturals Mouthwash Ingredients Not Necessarily Natural 

The plaintiff maintains that Johnson & Johnson uses a synthetic processes and chemicals that alter the initially natural and raw ingredients. The class action lawsuit maintains that the product’s ingredient label is not forthcoming enough with consumers about its sourcing. 

Johnson & Johnson’s claims of “natural ingredients,” “99% naturally derived,” and “free from artificial sweeteners” on the packaging of Listerine Naturals mouthwash are misleading, alleges the class action lawsuit. 

The lawsuit points out that Johnson & Johnson bases its language on the International Standards Organization (ISO) guidelines for natural ingredients and products. The class action lawsuit claims that these guidelines contain “numerous weaknesses and loopholes,” which allow for subpar “natural” products to make it to market. 

For himself and other Class Members, Phillips seeks restitution, correction of Johnson & Johnson’s alleged false advertising of Listerine Naturals mouthwash, and attorney’s and expert’s costs. 

This is not the first time Johnson & Johnson has been accused of falsely advertising its Listerine-brand mouthwash. In 2010 and 2014, class action lawsuits accused the company of falsely claiming that Listerine Total Care mouthwash can restore tooth enamel

    I use it, it’s free of artificial sweeteners and dyes, that’s a plus! Now I can’t buy it…. they discontinue d it. Not sure if any of you have been to the health food store where their mouth washes aren’t as effective in even more expensive. Sometimes you have to weigh your options. Something’s better than nothing :(
