A new class action lawsuit claims Joe & The Juice misleads consumers about the ingredients in its products.
Plaintiff Neda Ansari and five others filed the class action complaint against Joe & The Juice New York and Joe & The Juice US Holdings on June 4 in New York federal court.
The plaintiffs allege Joe & The Juice falsely advertises its products as containing olive oil, even though they actually contain 95% canola oil.
According to the Joe & The Juice class action, the company, which has over 65 locations in the United States and 385 stores globally, has built its brand on the promise of offering “healthy” and “high-quality” products.
The Joe & The Juice class action lawsuit alleges that the company claims to use only natural and organic ingredients in its juices, shakes, coffee and sandwiches, and that it has positioned itself as a lifestyle brand catering to health-conscious consumers.
Joe & The Juice class action alleges company’s products contain 95% canola oil
However, the plaintiffs allege that Joe & The Juice’s advertising and marketing campaign is misleading and deceptive. They claim that the company represents its products as containing olive oil on its menus, website and food delivery apps but fails to disclose that the “olive oil” used is actually 95% canola oil.
The plaintiffs argue that this misrepresentation is significant because olive oil is more expensive and has greater health benefits than canola oil. They claim that consumers are willing to pay a premium for products containing olive oil due to its antioxidant and anti-inflammatory properties.
The Joe & The Juice class action lawsuit alleges that the company’s use of canola oil instead of olive oil constitutes “olive oil fraud” and that consumers have been deceived into paying more for the products than they are worth.
The plaintiffs claim that they relied on the company’s representations when purchasing the products and would not have paid the same amount if they had known the truth.
They are looking to represent anyone who bought the products in the United States during the relevant statute of limitations.
The plaintiffs are suing for breach of implied warranty, violations of New York General Business Law and unjust enrichment. They are seeking certification of the Joe & The Juice class action, damages, fees, costs and a jury trial.
In another case of alleged misrepresentation, Country Crock Plant Butter is accused of misleading customers into believing the product is largely made of olive oil.
