Top Class Actions viewers say they’ve started to receive checks from a $2.5 million Jimmy Choo class action settlement.
The settlement resolves claims that luxury shoe and accessory retailer Jimmy Choo put customer’s credit card information at risk of exposure by printing too much of it on its retail receipts.
According to comments and posts on the Top Class Actions Facebook page, qualified Class Members who submitted valid and timely claims began receiving their Jimmy Choo settlement checks on Nov. 30, 2017 in the amount of $155.67 – close to the higher end of the previously estimated payment range of $75 to $175.
This settlement is the product of a credit card receipt class action lawsuit filed in October 2015 by plaintiff Kerri Wood. Wood alleges she and the Class Members received credit and debit card receipts from Jimmy Choo that showed either their card’s expiration date or too many digits of the card number.
Wood says she noticed the allegedly noncompliant receipt after shopping at a Jimmy Choo store in Palm Beach, Fla. Upon paying for her purchase with a credit card, Wood says she was presented a receipt that had the card’s expiration date printed on it.
Wood argues that in printing and providing these receipts, Jimmy Choo violated the federal Fair and Accurate Credit Transactions Act, or FACTA.
Passed in 2003 as a set of amendments to the Fair Credit Reporting Act, FACTA requires retailers who provide electronically-printed credit or debit card receipts at the point of sale to ensure those receipts do not reveal the card expiration date or more than the last five digits of the card number.
Wood argues Jimmy Choo’s alleged FACTA violations were intentional, making the company liable for up to $1,000 in statutory damage for each noncompliant receipt printed.
Jimmy Choo continues to deny Wood’s claims, and the settlement does not require the company to admit any liability.
Settlement negotiations began with a mediation session and carried on for several months. The parties reached an agreement in principle in November 2016 and submitted the proposed settlement for court approval in January 2017.
Distribution of the Jimmy Choo settlement was delayed by an appeal filed in June 2017. The appeal was voluntarily dismissed a few months later.
The Jimmy Choo credit card receipt settlement required the retailer to put up a $2.5 million settlement fund, to be distributed among qualifying Class Members after first covering class counsel’s court costs and attorney fees, a $5,000 incentive award for Wood, and the costs of settlement administration.
The deadline for submitting a Claim Form was March 17, 2017.
