An Indiana woman has filed a lawsuit against Janssen Pharmaceutical claiming diabetes drug Invokana caused stroke and other problems.
Plaintiff Jane L. began taking the popular diabetes drug Invokana in September 2014 and continued to take it until May 2015.
She claims that she experienced anInvokana caused stroke and other injuries as a result. Jane alleges that she took Invokana the way it was intended to be taken.
When Jane began taking Invokana, she believed it would help reduce her blood sugar. She relied on claims that Janssen made that Invokana is a safe and effective treatment for diabetes.
However, Invokana caused stroke in Jane, and she believes this was a direct and proximate result of taking the drug.
Jane alleges that her Invokana caused stroke and other injuries were preventable and resulted directly from the defendants “failure and refusal to conduct proper safety studies, failure to properly assess and publicize alarming safety signals, suppression of information revealing serious and life-threatening risks, willful and wanton failure to provide adequate instructions, and willful misrepresentations concerning the nature and safety of Invokana.”
The plaintiff claims she would not have used the drug had she known the risks and if Janssen had properly disclosed the risks.
She believes that Janssen actively concealed from both patients and the medical community the true risks of the drug.
Jane alleges she has suffered pain and suffering, emotional distress, loss of enjoyment of life and economic loss including significant expenses for medical care and treatment which will continue in the future.
She is seeking actual, compensatory and punitive damages from the defendant.
Diabetes Drug Invokana
Type-2 diabetes affects nearly 30 million people in the United States and requires specific medication to control. However, Invokana, a popular diabetes drug has been linked to conditions like stroke and ketoacidosis, both of which can potentially be fatal.
Other possible Invokana side effects include lactic acidosis, heart attack, kidney failure, kidney stones, urinary tract infections and coma.
The CANVAS study showed, in 2013, that there was a 46% elevated risk for stroke among Invokana patients within the first 30 days of treatment. The FDA believed that there were other issues at play regarding these findings, not simply that Invokana caused stroke, and approved the drug regardless.
Jane is bringing forth claims of product liability with respect to manufacturing defect, defective design and failure to warn, breach of express warranty, breach of warranty of fitness for ordinary use, negligence, breach of implied warranty, fraudulent misrepresentation, negligent misrepresentation, fraudulent concealment and fraud.
This Invokana Caused Stroke Lawsuit is Case No. 3:17-cv-00974-BRM-LHG in the United States District Court of New Jersey, Trenton Division.
