An Ohio couple claims that popular diabetes drug, Invokana caused a stroke in the wife.
They have filed a lawsuit against Janssen Pharmaceuticals and Johnson & Johnson to seek compensation for damages.
Plaintiffs Tara H. and Brian H. say that when Tara began taking the diabetes drug for her type-2 diabetes, Invokana caused a stroke.
In October 2015, Tara was prescribed and began taking Invokana.
She says she used it in the way that it was intended and she agreed to take it in an effort to reduce her blood sugar.
Tara relied on claims made by Janssen and Johnson & Johnson that Invokana was safe and effective as a diabetes drug.
Tara claims that patients who take Invokana, including herself, have suffered and may continue to suffer severe and permanent personal injuries including strokes, kidney damage, diabetic ketoacidosis, cardiovascular disease, thromboembolic injuries and myocardial infarction.
Plaintiff Claims Invokana Caused a Stroke
Tara says that as a direct and proximate result of taking Invokana, the “unreasonably dangerous drug” has caused and will continue to cause injury to her.
She claims that Janssen and Johnson & Johnson knew or should have known that Invokana carried with it the risk of developing strokes.
The lawsuit states that the plaintiff’s injuries were preventable and resulted directly from the defendants’ “failure and refusal to conduct proper safety studies, failure to properly assess and publicize alarming safety signals, suppression of information revealing serious and life-threatening risks, willful and wanton failure to provide adequate instructions, and willful misrepresentations concerning the nature and safety” of their drug.
The plaintiff claims that she would have never taken Invokana had she known that she would have known the risks of stroke.
Tara and Brian believe Invokana caused a stroke and raise claims of manufacturing defect, defective design, failure to warn, breaches of express and implied warranty, breach of warranty of fitness, negligence, fraudulent misrepresentation, negligent misrepresentation, fraudulent concealment, loss of consortium and fraud.
The plaintiffs are asking for compensation for medical expenses, pain and suffering, loss of consortium and attorneys’ fees, among other requests.
The Dangers of Invokana
