A plaintiff has come forward to file a new Pinnacle metal on metal hip replacement lawsuit against DePuy. The plaintiff has lodged a complaint against DePuy and Johnson & Johnson due to allegations that the Pinnacle metal on metal hip replacement components were defective and caused her to suffer serious injuries.
Many patients have lodged similar claims in the direction of DePuy after allegedly being hurt by an implant they expected to help them.
The lawsuit in particular claims that the hip implant design was defective from the outset and caused patients, who thought they were receiving a hip implant replacement to help them, to suffer serious side effects. The DePuy Pinnacle system was originally approved by the U.S. Food and Drug Administration in 2010 through the 510(k) process, which enables a streamlined application and no clinical testing.
In the Pinnacle metal on metal hip replacement lawsuit, the plaintiff argues this fast-track approval meant that the FDA did not have greater insight into the possible dangers of the allegedly defective device.
The DePuy Pinnacle metal on metal hip replacement system uses four different components: a cup made of titanium metal, a liner, a metal femoral stem, and a metal femoral head. Information revealed in a growing number of adverse event reports indicates that patients suffered serious side effects using the Pinnacle metal on metal hip replacement, and that many of them had to go through the unfortunate situation of revision surgery.
Patients who were injured by the Pinnacle metal on metal hip replacement system allege that the manufacturer knew about the dangers and misled them by using marketing materials that indicated these devices for safe and effective over the course of time. Many of those patients who suffered the additional cost and pain of going through a revision surgery, or of coping in day to day life with what they claim is a defective system, want to hold the manufacturers responsible in lawsuits.
The Pinnacle metal on metal hip replacement lawsuits all have a similar claim that ever since it was brought onto the market, the Pinnacle system had a higher rate of failure across the world. The plaintiff in the latest Pinnacle metal on metal hip replacement lawsuit underwent a right hip THA surgery in 2009. The plaintiff had to go through hip revision surgery in Jan. 2018 as a result of pain and premature failure linked to the device.
When a metal on metal hip implant starts to break down or cause pain inside the patient’s body, the consequences can be severe. The patient might not even draw the connection as he or she begins to experience unexplained pain, but a visit to the doctor could reveal that the pain and other mobility issues are directly related to the hip implant. If this happens, revision surgery might be required, putting that same patient at risk of other complications or side effects.
The Pinnacle Metal on Metal Hip Replacement Lawsuit is case 3:18-CV-01461-K filed in the United States District Court, Northern District of Dallas Division.
