Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

The Hyundai Oil Consumption Lawsuit is Cho, et al., v. Hyundai Motor Company, LTD., et al. in the U.S. District Court for the Central District of California.

My 2017 Hyundai Santa Fe had oil consumption issues at about 70,000 miles. Hyundai replaced my engine. Now, that engine has started having the same issue at about 70,000. I contacted the dealership and they say there is nothing further that they can do. I live in MO and would like to pursue class action settlement as this is a time consuming and costly issue needing to add oil every week or so.

I bought a 2018 Hyundai Sonota in May of this year. I have had oil issues ever since. I have to check my oil every week to week and a half and it will be dry as bone!!! I have also had the oil checked and changed. Within a month or two the oil would become very dark. This is insane to say the least. I was told just yesterday by a mechanic that there is no leak, after having it change while there, which he stated the engine needs to be replaced. Please HELP!!!

My 2017 Hyundai Accent has engine problems and wont crank. It has been acting up for a long time. burning lots of gas and consuming a great deal of oil. On Feb 25 (Sat) 2023 late evening by Hyundai accent engine began making noises then it began losing power and eventually coasted to the side of the road and would not crank back up. I had to have it towed to my dadโ€™s house. a few days later I got someone to come look at it to see if he could fix it. I thought it was the starter or a dead battery at first. The mechanic tried different things and found out that it wasnโ€™t the starter nor the battery. Then he said he wanted to look at something. he drained the oil out then took the oil plate or pan off and thatโ€™s when he found the real problem. He said he found metal shavings in the oil pan. He said it was the Rod and Rod bearings. He said it needs to be replaced or replace the engine which either is very costly. Since finding out the bad news I have discovered that this is a common problem with the Hyundai engines. I found others with a Hyundai accent who have had similar engine problems. Clearly if I had known these cars had major engine problems, I would have never bought this vehicle in the first place!

Note: My 2017 Hyundai accent had only 40ish thousand miles when i purchase it now it, now it only has 98, 675 miles when the engine went out, less than the 100,000 miles warranty on the actual engine.

    1. Allie N Cox says:

I have a 2017 hyundai tuscon limoted. I had the same exact issues as you. My mechanic told me he seen metal shavings in my oil and it was a result from my rod and rod bearings. He said it would be cheaper to by a new motor than to mess with patch work because the damages to my motor would only cause a domino effect of problems. I would love information on this class action lawsuit if I am a candidate. If anything I just want my car fixed.

  10. Rickey Guyton says:

I have to add oil to my 2019 Hyundai Tucson every week, I drive maybe 200 miles a week, and add 1 quart a week, I bought it brand new, so Iโ€™m am the original owner, HELP
