  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.ย

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I have a 2017 Tucson. My car is burning oil too fast. I have been working with the dealership since March, taking it in every 1000 miles so they can document what is happening. It has been so frustrating and time consuming.

    My 2016 Hyundai Sonata needs oil added every other day for the past year I had a new engine put in right before this problem started from the dealership!!

    My 2017 Hyundai Sonata has had oil issues since I got it about 3 years ago. The sales person promised that their shop would look at why the oil light was going on. I took it in and was told absolutely nothing was wrong. It has gotten constantly worse and now I am putting oil in several times a week! So frustrating

    Iโ€™ve been following this for a while. Check my oil every week and it routinely needs a top off because itโ€™s just disappearing. Hyundai will not do an oil consumption test because I will not pay $600 to have the valve gasket changed. They know itโ€™s not leaking and they know the problems but will not back their product? One tech ( bless his heart) blurted out the only fix is a new engine. Well, Hyundai?!

    I am the second owner of my 2017 Hyundai Sonata. Over the past five months my cars oil consumption has increased dramatically. The car starts, then starts to shake, no movement when pushing on has pedal , engine and oil pan light came on and immediately turned it off. This all occured within 15 seconds. Last months oil change required 2 1/2 quarts. This time it needed 3 quarts.

    I have a Hyaundi 2020 Kona that Iโ€™m leasing till December. I never felt more unsafe in a car in my life .the very first 2 months of having my car I was having to bring it in due to it would start making noises n the start shaking the engine light was on with in the first 2 months of having the car they said it was a sensor.

    Me being a younger woman who has never dealt with car issues I just assumed that was all it was.

    eventually it got to the point where my car engine light would turn off and on ( I was thinking itโ€™s still the sensor) as time went on

    The engine light just stayed on it would just stall in the middle of the road putting mine and other peoples life at risk I even got in a car accident because the car stalled in the middle of the road I had to take off work for days at a time and had a black eye and significant back pain as a result of this .

    The 1st year I had the car it started stalling misfireing eventually it got so bad this year 2023 that I needed to get the whole engine replaced as the car would turn on but would not move at all I have less then 30,000 miles on this car . When I brought it in because it would not start I had to have it towed twice.

    after fighting with them that this is a faulty car they had left my car on overnight. The next morning I go to pick it up it does not start they said they tested it and drove it that morning and I told them obviously if you had done that you would have noticed the car didnโ€™t turn on . They were trying to say I had a bad battery I told them well it looks on the paper work the battery was checked and it looked like it passed . So somebody wasnโ€™t doing their job, they then told me I had to buy the new battery and they were no longer going to give me a renter car . I had no means to get to work .I had to have my boyfriend take me to work when he had work meetings that were extremely important.
    Iโ€™m lucky I didnโ€™t lose my job !

    I am beyond terrified to ever lease or buy another car again .

    A less then 3 year old car and it needed a whole new engine and battery.
    One of the gentleman I had spoke to even said I canโ€™t believe your car didnโ€™t catch on fire. the car was spilling oil into the engine because of a spark plug issues they even had the audacity to say I didnโ€™t put oil in the car when I have valid proof I had gotten a oil change two weeks prior to my engine completely going idle.
