  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.ย

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    2017 Tucson burning oil. Started at 60,000 miles and got progressively worse. It now has 83,000 miles on it and burns 2 qts oil in 1000 miles. I complained to dealer for over a year, their earliest appointment to diagnose is 2 months out. So much carbon buildup that it spark knocks so bad that it is not drivable. I have filed a case with Hyundai of America and canโ€™t see any help in the near future.

    2015 Hyundai Santa Fe Sport . At this point in time my vehicle needs almost three litres of oil per 5000 km. I must constantly check oil levels. At times engine idle drops suddenly almost stalling. Big disappointment in Hyundai. Had called Hyundai a few years ago and was told my vehicle did not lose enough oil to be covered under my warranty. Joke

    I have a 2018 Hyundai Sonata and have been dealing with the oil issue for a while. Just did an oil change in January and now light is on with car running rough. Iโ€™ve started carrying extra oil in the car between servicing.

    2012 Sonata every week quart of oil. If my wife has the car an doesnโ€™t check it I have almost no oil and the oil light doesnโ€™t even come on .

      I have a 2017 sonata and I have the same problem. The oil light never comes on unless there is already no oil left in it. And Iโ€™m not even due for a oil change for another 2000miles. Itโ€™s really frustrating that every other week we have to buy more oil to add because it just magically disappears. But we also donโ€™t see no oil spill on the ground or anything. Itโ€™s just gone!

    WE HAVE 2 HYUNDAI Santa Fe SPORTS,2017-2018,THE 2017 with 60,000 MI. is GOING THROUGH the OIL CONSUMPTION TESTS as we Speak.we had added 1.5 to 1.75 quarts, at the 4,000 mi. mark before this oil change, we have a local mechanic at SELECT AUTO SERVICE,that always does our oil changes, with FULL SYNTHETIC OIL,AND TOP QUALITY SYNTHETIC OIL FILTER,BETTER THAN WHAT the HYUNDAI DEALER USES. HE HAS SAID HE WILL SPEAK FOR US, ALSO the local HYUNDAI DEALER in AUGUSTA MAINE, totally Agrees with us!! HYUNDAI is playing STUPID,I AM IN,as I expect the second Santa Fe is Next!

    My 2017 Tucson has been back to the dealership 4x in 4 months with a blinking check engine light and no permanent fix. Iโ€™m so fed up.

    I have a 2018 Hyundai Santa Fe sport and have the same issues. I have to add a qt of oil every week to keep it in the acceptable range in the dipstick. No leaks detected on the outside itโ€™s parked in my garage, and a permanent parking spot at work so I can see the spots if there were any. Called Hyundai and they want to run diagnostics, then a new engine is $8k-$9k and it seems to be on back order.

    My wife purchased a 2017 tucson as well itโ€™s been using at least 3/4 litres of oil every 1000 km we been doin consumption testing at the dealership here for the last 5000km called them up to see the end results saying that it was normal to be using that much I laughed and said u think I got stupid writen on my forehead told them u think itโ€™s normal to use that much fukin oil in this period almost 4 to 5 quarts so yโ€™a u can had me to the lawsuit as well this is bs and Iโ€™m not sitting on this people shouldnt tolerate this crap

    I have a 2017 Tucson. It is in the repair shop from oil consumption but was going to the transmission. This is day 8 and still no word on when it will be fixed!
