Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

The Hyundai Oil Consumption Lawsuit is Cho, et al., v. Hyundai Motor Company, LTD., et al. in the U.S. District Court for the Central District of California.

I have a 2011 Hyundai sonata that burns a lot of oil I have top off my oil very very often and is very costly.

  2. Garrett Long says:

I have a 2016 Hyundai Tucson. Iโ€™ve been on top of my oil due to the higher oil consumption issue. It was discovered August 2022. Before heading home from a road trip I checked my oil level, and there was none to be found on the dipstick. No low oil pressure light turned on or anything, leaving me unaware. Now I continually add oil. I have noticed not exceeding three thousand RPM will slow the oil burn rate so just watch how heavy your foot is. Every 2-3 fill ups for gas I add a quart of oil, and thatโ€™s with easy driving.

A few months ago my brotherโ€™s 2015 Hyundai Sonata had an engine failure. The mechanic that diagnosed the engine had the following findings. The block was cracked, and third cylinder piston caused the damage at some point. They think really low oil levels may have caused it, but they arenโ€™t sure. Our guess is that it was due to the high level oil consumption issue.
Iโ€™ve called the dealership and they want to charge over $200 to tell you the answer that is already very clear. High oil consumption on an engine that is just hitting 70k miles to the date this comment is posted. Only solution is to have the oil consumption test. Then a replacement of the engine 6-8k. Vehicle is paid off as well. Glad to see a class action lawsuit is open. Just waiting to see the end result or potential forking several thousand for an engine replacement.
Wanted to share that information though.

  5. JUSTIN WILCOX says:

I have a 2017 Hyundai Tuscon and it goes through 5 quarts of oil in 3 months, with very limited driving, low mileage. The thing is, I never even had a leak since I owned it.

  6. Daniel Izguerra says:

Iโ€™m have a 2015 santa fe turbo sport . Iโ€™m the second owner and I have had issues with oil consumption since I bought it. I got a oil change 3 weeks ago and today it started to sputter while I was on the highway. I pulled over ,luckily there was a crash investigation site near by. I check oil and there was just a smudge left on the stick, I add oil , start up car and all sorts of sensors are now showing. Now car wonโ€™t start. Had to get a tow and Iโ€™m taking to hyundai tomorrow.

  7. Tammy Grigg says:

I have a 2017 Sante Fe Sport. Starting using two quarts every other week. Called Hyundai dealer told to pay $8,000 for new engine or buy a new carโ€ฆ I Just bought the car a year ago. I am not sure what to do. Buying a new motor for a car with less than 70,000 miles seems ridiculous to me. How can I get on the class action suit?

  8. Brandon says:

My wife has a 2019 Tucson , has 79k on it and each week I hear a light vibration noise. Every time itโ€™s about a quart or more low . It causes more issues to the catalytic converter is starting to throw a engine code.

  9. Anthony Morello says:

My 2010 sonata is always low on oil and engine has been shuddering.Do you have to be in on class action lawsuit in order to get vehicle repaired?

    1. Steven Ervin says:

My 2011 Hyundai Sonata same way and as of 2 weeks ago it just stalled going down road, pretty sure motor gone bad.

  10. Jon F Hovey says:

I have a 2014 Hyundai Santa Fe started burning oil a year ago. Added over a gallon every 2 weeks of just driving around town Iโ€™d say about 100 miles. It finally gave up after I had just changed the oil and filter. Went about 20 mile and stopped completely. Sounds like itโ€™s gonna need a rebuild. Itโ€™s my 5th hyundai and the first one Iโ€™ve ever had terrible with very disjointed and think they should help get it fixed. It was maintained religiously obviously a bad design.
