Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    Please add us. We have a 2013 hyundai sonata 2.4l and it is burning all the oil within a month time driving less than 1000 miles. Car stalled and dealer said they know of the issue and this desnt fall within the engine recall yet. said is was a failure of catylitic convertor. Which is clogged with carbon deposits from the burning oil. Want us to pay 1800 dollars for cat repair along with plugs and injectors all of which are fouled with oil. No reimbursment. then they can do a oil consumption test to determine if burning too much oil, but they already know it is since they did oil change one month prior and now no oil in it and in limp mode. they dont want to do anything about it nor does headquarters. We have bought 5 cars from them and this how they do loyal customers? Never again.

    I have just bought a 2016 handi sonata fe and my engine just stalled on me and as for my oil Iโ€™ve had to put oil in it at least once a week since getting it and just had a complete oil change done.
    Where the oil goes uses up the oil faster than I could keep it in there. Itโ€™s like the oil would burn up with in 48 hours and stays dried. Please works someone contact me and talk with me to let me know whatever it is I need to know and should know.

    My 2014 ELantraa has been burning oil since 100,000 miles and is now 198,000 and burning 2 1/2 quarts between oil changes and is getting worse. The service department says tough live with it , because we are over 100,000 miles

    Both oil changes coming due & there is no oil. Told by where I bought it to drive it without oil till I could get it to them ๐Ÿคฆโ€โ™€๏ธ

    Please add me, I have a 2016 Hyndai sonata thats burning so much oil and sounds like its gonna stall out everytime I make a stop. I cant believe hyndai isnt doing more to help all of us. They need to step up and do the right thing here. If we can give them our hard earned money,they need to give us an engine that works!

    Add me to the list. My 2018 Elantra has only 76,000 kmโ€™s on it and now using oil. Hyundai say this is normal, quoting a 2003 Technical Service Bulletin which states 1 litre of oil per 1,600 kmโ€™s may need looking into.

    I have a 2015 sonata and replacing oil every week. I went through a consumption test with Hyundai and they said Hyundai will replace the engine but will not pay for labour which is $4,150 CAD. Absolutely ridiculous. Please add me

    2017 Santa Fe Sport; oil consumption problems, when I start the car and drive, the car will only go 20 mph until warmed up then it has trouble changing gears. Cannot drive it on expressway because it wonโ€™t get up to speed
