Huffy UTV class action overview:

A new class action lawsuit accuses Huffy Corp. of selling utility terrain vehicles (UTVs) that pose a fire risk.

Plaintiff Jackie Crowe filed the class action complaint against Huffy Corp. on April 30 in Ohio federal court, alleging violations of state and federal consumer laws.

The Huffy UTV class action lawsuit alleges the company sold defective ride-on Torex UTVs at Walmart between August 2019 and December 2024. The UTVs have a wiring defect that can cause overheating and fires, leading to a recall of 24,700 units.

The lawsuit claims Huffy knew about the defect but failed to warn consumers. Crowe alleges her child was burned while using one of the UTVs, which emitted smoke and overheated.

Furthermore, Crowe claims Huffy’s recall only offers a repair remedy, not refunds, leaving consumers with unsafe products.

Huffy UTVs could have used safer designs, lawsuit claims

Crowe alleges Huffy’s UTVs are defective because they have a connector within the wiring system that degrades, causing the toy to overheat and pose a burn hazard and fire risk to children.

The lawsuit claims Huffy failed to use safer designs and materials available at the time of manufacture, making the defect avoidable.

Crowe says she bought a UTV for $600, unaware of the fire risk. She alleges her child ran inside screaming that their feet were on fire after riding the UTV, which emitted smoke.

The lawsuit seeks to represent all U.S. consumers who bought the recalled UTVs. It alleges Huffy engaged in fraudulent, deceptive and unlawful conduct by selling unsafe products without disclosing the defect.

Crowe is suing for unjust enrichment, breach of warranty, fraudulent concealment, strict liability and negligence. She seeks certification of the class action, damages, fees, costs and a jury trial.

A separate class action alleges Huffy’s Ride on Tonka Dump Trucks were sold with a defect that can cause the controller to overheat, posing a burn hazard to children who operate the toys.
