Allegations in a Class Action DuraPro Toilet Connector Lawsuit
A group of plaintiffs have filed a class action toilet connector lawsuit against Interline Brands, Inc. alleging the toilet connectors supplied by the company are prone to failure, causing catastrophic water damage in the homes of consumers.
The toilet connector device is responsible for linking the shut off valve from water fixture to the underside of the toilet, using a plastic coupling nut to allow water to flow into the toilet tank. With respect to the DuraPro toilet connector, the plastic coupling nuts are allegedly “uniformly defective” and fail, causing the flow of water to be unrestricted, leading to substantial property damage.
The plaintiffs allege that Interline knew about the defective toilet connectors since 2007 based on email exchanges to the supplier in China. Supposedly, the manufacturers in China told Interline that they had fixed the problem and it only occurred from old inventory.
“Interline had full knowledge of the defective condition of the Toilet Connectors and rather than disclose, warn, or recall these defective Toilet Connectors, Interline has ignored this mounting problem, and exposed Plaintiffs and the putative Classes to a substantial risk of significant property damage,” the Durapro toilet connector lawsuit alleges.
The toilet connector lawsuit seeks to compensate homeowners who have already sustained damages caused by the allegedly defective plastic coupling nut, as well as to circumvent future damages by “publicly disclosing the existence of the defects and establishing a protocol to remove them from properties.”
The plaintiffs have brought forth several counts against Interline including strict liability for design defect and failure to warn, Declaratory Judgment Act, violations of the Florida Deceptive and Unfair Trade Practices Act Violation of the Colorado Consumer Protection Act, unjust enrichment, violation of Magnuson-Moss Consumer Products Warranties Act, and breach of implied warranty of merchantability.
In addition to class certification, the plaintiffs are seeking declaratory, equitable and-or injunctive relief, award of damages, costs of the lawsuit and any additional relief
