Puritan’s Pride, a vitamin and supplement company, is the target of a deceptive pricing class action lawsuit. The plaintiffs allege that the company uses deceptive pricing like fake discounts to lure customers into spending more money than they otherwise would on products because they think they are getting a better deal.
Businesses use a number of deceptive pricing practices. For instance, Puritan’s Pride has been accused of using endless “Buy One Get One Free” (BOGO) sales that convince consumers the sale is limited, which pushes them to make their choice and their purchase now, while the discount is still available and they can save money.
According to the deceptive pricing class action lawsuit, however, Puritan’s Pride keeps their Buy One Get One Free sales going year round, and has, at this point, been continuously offered for four years or more.
Since the sale is perpetual, the lawsuit claims that the supposedly discounted price is actually the “regular” price. Though customers aren’t saving any money at all, they are being told that they are, which can influence their decision to purchase a product.
Puritan’s Pride Lawsuit Over Deceptive Pricing
Two California consumers filed a lawsuit over Puritan’s Pride deceptive pricing, claiming that they purchased a number of products from the company that were part of a sales promotion — either “Buy One Get One Free” or “Buy One Get Two Free.”
According to the lawsuit, “the marketing and advertising campaign for the Products was false, deceptive, and misleading because the ‘free’ Products promotion never stopped.”
The complaint alleges that the Puritan’s Pride deceptive pricing claims violate California consumer protection laws.
Indeed, according to federal law, promotions like these should last no more than 6 months during any given 12-month period. This is meant to distinguish between regular pricing and discount pricing, so that consumers know they are actually getting a good deal that is not always available.
Discount pricing that lasts the majority of the year essentially becomes regular pricing, and the consumers that purchase products because of these discounts may be being misled about the deal they are getting by buying these products during the supposed sale period.
The class action lawsuit is intended to include any and all products purchased under the Puritan’s Pride deceptive pricing scheme.
The deceptive pricing practices allegedly used by Puritan’s Pride are not unique. In fact, allegedly fake discounts and deceptive pricing are common practices in retail stores across the country.
