Patients with a DePuy ASR hip implant may have a particularly high risk for hip revision surgery and its related complications.
Patients who have undergone hip revision surgery after being implanted with a DePuy ASR hip implant may qualify for payment from a DePuy ASR settlement. The metal-on-metal hip implant allegedly has a high rate of failure, leading many patients with the implant to undergo hip revision surgery to remove the device and repair any damage.
The process can be difficult and expensive, but consumers may be able to seek compensation through a massive DePuy ASR settlement for patients who underwent hip revision surgery since March 2015.
Metal-on-metal hip replacements such as the DePuy ASR hip implant are reportedly associated with a higher chance of complications.
According to the FDA, “metal particles from a metal-on-metal implant may cause a reaction around the joint, leading to deterioration of the tissue around the joint, loosening of the implant and failure of the device”.
Complications associated with metal-on-metal hip replacements include an increased risk of cancer, degenerative heart disease cardiomyopathy, non-cancerous tumors, swelling, severe discomfort, and metal poisoning. These complications can cause implant failure, requiring hip revision surgery to replace the failed implant.
In hip revision surgery, the original hip implant is removed and replaced with a new device which serves a similar function. Hip revision surgery is a difficult process because complications associated with implant failure may compromise the bone and tissue surrounding the joint. Such damage increases the difficulty of the hip revision surgery, as a surgeon may need to graft new bone in order to attach the implant.
In addition to a difficult surgery and recovery, hip revision surgery is associated with many risks including anesthesia complications, excessive bleeding, blood clots, infection, pulmonary embolism, and further implant failure.
For a hip replacement, a high hip revision surgery rate may be indicative of a design or manufacturing defect, often leading to a recall. This was that fate of the DePuy ASR hip replacement when, in 2010, the U.S. Food and Drug Administration (FDA) announced a recall of 93,000 units of the device.
The FDA initiated the recall after the UK joint registry released data that found 13% of DePuy ASR hip implants required hip revision surgery. Following the recall announcement, numerous consumers filed lawsuits against the manufacturer.
In 2012, Johnson & Johnson announced that it would settle the first lawsuits regarding the DePuy ASR hip implant and its high risk of hip revision surgery. In the announcement, Johnson & Johnson said they would pay a combined $600,000 to settle three separate lawsuits, with each plaintiff receiving $200,000 each.
Compensation may be available for patients who have needed hip revision surgery since March 2015 due to the following problems: failure of the hip implant; dislocated hip; leaking of toxic substances into the bloodstream from the hip implant; metal poisoning; tissue death for any tissue surrounding the hip implant; non-cancerous tumors or pseudotumors surrounding the hip implant; degenerative heart disease or cardiomyopathy; or cancer.
If you or a loved one had to undergo hip revision surgery due to a defective DePuy ASR hip implant, you may be eligible for legal compensation through a settlement. Compensation from a settlement could help consumers pay medical bills, support themselves after permanent disability, and more.
