A tiny gland nestled on the underside of the brain, the pituitary, produces many important hormones. One of these is the Human Growth Hormone (HGH). Like several other hormones, HGH plays an important role in a person’s health, and physicians may supplement a person’s HGH with synthetic versions. This process is tightly controlled, and may have side effects. However, some companies have allegedly marketed HGH “boosters” with false claims of influencing HGH levels and having other health effects.
Real HGH
Hormones are a class of chemicals that the body uses to control itself. In the case of HGH, the body uses it to regulate growth from the cellular level and up. In healthy humans, it helps the body grow and change during growth and development. HGH has a very complicated role in human physiology, and plays a role in everything from sex drive to appetite. Physicians have a synthetic version available to treat certain growth disorders in humans. However, this is tightly regulated, as HGH can have similar effects to anabolic steroids and testosterone supplements in that it may enhance athletic performance. Many professional athletes are tested for the presence of HGH, including Olympic athletes.
Alleged Marketing Concerns
Some companies have allegedly used the hype and confusion surrounding HGH to sell products. These products are alleged to alter HGH by “boosting” the body’s ability to produce HGH or “unlocking” the body’s own HGH. These products purport to do anything from improving blood sugar levels to reverse the aging process.
Such claims may run afoul of several different areas of consumer protection law. First, it is illegal to make a drug claim for a product that has not been submitted to the FDA for approval. In order to market a drug, manufacturers must test a substance carefully for both safety and efficacy. If a “supplement” does not go through this process, it is illegal for the drug’s labeling or advertising to make claims that the drug can in any way diagnose, treat, or cure a disease.
It is also in violation of the law to fraudulently market a product. So if the manufacturer of a supplement claims that supplement reverses aging or improves vision and it does not, the company may be vulnerable to legal action.
Legal Action
A class action lawsuit investigation has been launched to explore the possibility of legal action against the manufacturers of HGH supplements that make false and/or illegal marketing claims. The HGH supplement class action lawsuit would allege that supplement manufacturers either made drug claims or used false advertising
Class action lawsuits are a type of group lawsuit where a group of plaintiffs allege that they have suffered similar damage at the hands of the same plaintiff. Group lawsuits, like class action lawsuits, are designed to save resources for all parties involved. The plaintiffs can pool their money for the cost of representation, the defendant only has to face a single lawsuit, and the court system only has to manage a single case.
