The Stryker Corporation is facing a growing multidistrict litigation (MDL) from patients who received metal hip implants containing the allegedly defective Stryker Accolade TMZF hip component.
One of the most recent Stryker metal hip lawsuits comes from a Pennsylvania couple alleging the husband experienced device failure due to the Stryker Accolade TMZF hip component.
The Stryker Accolade TMZF stem is part of the ball and socket joints in some of the company’s metal-on-metal hip implants, often paired with the LFIT Anatomic Femoral Head. Patients across the country have been reporting early device failure and having to undergo early revision surgery, which some say is caused by defects in these metal hip components.
Plaintiffs Scott S. and Carol S. are filing this Stryker metal hip lawsuit alleging Stryker Corporation either knew or should have known about the defective nature of their metal hip implant and the high failure rate associated with the Stryker Accolade TMZF stem.
According to the Stryker metal hip lawsuit, Scott had the all-metal hip prosthetic implanted in his right hip on April 28, 2005. Scott did this for typical treatment purposes and was led to believe the Stryker metal hip implant would restore hip function and allow him to return to normalcy.
However, this was allegedly not the case, as Scott reportedly experienced serious metal hip implant complications at some point after the procedure and was eventually forced to undergo revision surgery. To resolve the debilitating pain and other metal implant complications, Scott had the device explanted on Oct. 25, 2016.
Scott says he has since had to contend with intense recovery and has chosen to file legal action soon after discovering the device’s reportedly high failure rate.
Overview of Stryker Accolade TMZF Stem Problems
It is important to note that the Stryker Accolade TMZF hip stem was recalled in 2009, 2011 and 2013 due to reported manufacturing issues and product packaging.
Stryker recently issued a voluntary recall of its LFIT V40 femoral heads due to reports of complications such as metallosis and device failure. Many of the reported metal hip complications stem from the all-metal ball and socket joints interacting and then shedding metal ions into the bloodstream.
This can lead to the development of metallosis, or blood metal poisoning, and can compound the overall health of the patient by inducing other problems including debilitating pain, fretting, corrosion, infection, pseudotumor formation and tissue death.
These problems often force patients to undergo revision surgery to explant and replace the device which is considered riskier than the initial procedure.
At all times relevant, Scott used the metal hip implant for its intended purpose and followed all post surgical instructions. He alleges the information provided with the implant did not adequately warn him of possible metal hip complications or other contributing factors which may have forced Scott to undergo revision surgery. Scott is filing his Stryker metal hip lawsuit in MDL No. 2768, where it will stand alongside other claims alleging similar injuries.
Scott states he would not have used the Stryker metal hip implant if he had been aware of all the problems associated with the Stryker Accolade TMZF hip component.
This Stryker Accolade TMZF lawsuit is Case No. 1:17-cv-12405-IT, in the U.S. District Court for the District of Massachusetts.
