Johnson & Johnson is facing a new C-Qur mesh lawsuit from a Georgia woman filing legal action on behalf of her late husband. This Georgia woman alleges the company’s hernia mesh products caused her husband to suffer fatal injuries and is filing this C-Qur mesh lawsuit for wrongful death.
Plaintiff Kathy E. is filing this C-Qur mesh lawsuit on behalf of William E. who opted for the hernia mesh product to treat his incarcerated ventral hernia. William underwent hernia mesh repair surgery on June 26, 2015, for his injury and opted for the product after reviewing Johnson & Johnson’s marketing materials.
Overview of C-Qur Mesh Lawsuit
Even though William used the C-Qur mesh product for approved purposes and followed all medical instructions, he still suffered hernia mesh complications. Due to these hernia mesh complications, William had to undergo revision surgery on July 9, 2015 after being admitted for severe abdominal pain and ascites appearing on the surgical area.
Several weeks later, William had to undergo additional hernia repair due to a potential incarcerated, or strangulated, small bowel, and he would have to undergo a number of other medical procedures to treat his hernia repair complications.
These hernia mesh complications allegedly led to his death on Jan. 31, 2017, reportedly due to a number of serious health conditions including respiratory failure, acute renal failure and septic shock.
Kathy filed this C-Qur mesh lawsuit soon after William’s death, alleging Johnson & Johnson either knew or should have known of the serious hernia mesh complications associated with their product.
Other hernia mesh lawsuits have alleged the company’s hernia mesh products have induced a number of serious side effects including chronic pain, recurrence of hernia mesh problems, infection, mesh deformation, improper healing, inflammation, adhesion to internal organs, erosion, nerve damage and death.
Kathy opted to file this C-Qur mesh lawsuit on behalf of her deceased husband. Kathy alleged the company either knew or should have known of the potential hernia mesh complications associated with their product and failed to warn the public.
In addition, William’s physicians reportedly did not receive any information regarding these potential side effects until Johnson & Johnson issued an Urgent Field Safety Notice regarding its certain hernia mesh products.
Johnson & Johnson announced its market withdrawal of certain hernia mesh products in May 2016 with Ethicon Inc. stating it had failed to sufficiently identify the factors that may be contributing to the high failure rate.
Ultimately, the devices were withdrawn from the market in May 2016 after studies revealed a higher than expected failure rate. Hernia mesh has been used in the medical community for over 50 years, but patients have been reportedly experiencing problems for years.
Johnson & Johnson had marketed the C-Qur hernia mesh as a safe and sterile option for patients needing to undergo hernia repair, but had reportedly failed to sufficiently describe potential side effects.
Kathy states that William never would have opted for the C-Qur hernia mesh product if he had known the severity of the possible side effects.
This C-Qur Mesh Lawsuit is Case No. 1:17-cv-02324-RWS in the U.S. District Court for the Northern District of Georgia, Atlanta Division.
