Goli Nutrition class action lawsuit overview:

A new class action lawsuit alleges that Goli Nutrition misleads consumers about the amount of melatonin in its Dreamy Sleep Gummies.

Plaintiff Michael Ring claims Goli’s Dreamy Sleep Gummies are misbranded because the label indicates there are 60 gummies, each with 5 milligrams of melatonin, when in fact the serving size is two gummies.

As a result, the bottle actually contains 30 servings, not 60 as consumers expect, the Goli class action lawsuit alleges.

Ring argues that consumers reasonably expect each of the gummies in the bottle to contain 10 mg of melatonin.

The Goli class action lawsuit points to a recent article by consumer advocate Edgar Dworsky, who warns consumers not to be fooled by pill bottle quantities, stating consumers reasonably assume that the number of pills or gummies in a bottle corresponds to the strength advertised on the label.

Goli melatonin gummies allegedly fail to clearly disclose serving size

Ring claims the Dreamy Sleep Gummies label does not adequately disclose that consumers must take two gummies to get the promised 10 mg of melatonin.

The Goli class action lawsuit points to other brands of melatonin gummies, such as GNC and Nature Made, that clearly indicate the serving size on the front label.

Ring asserts that Goli’s failure to disclose the correct serving size constitutes a false and misleading representation that results in consumers paying a premium price for the product. He claims the Dreamy Sleep Gummies are sold for $14.99, which is more than they would sell for if they were accurately labeled.

Ring filed the Goli class action lawsuit on behalf of himself and a proposed class of consumers who purchased Goli Dreamy Sleep Gummies in New York.

The Goli class action lawsuit asserts claims for violations of New York’s General Business Law.

Earlier, a Washington federal judge denied Amazon’s motion to dismiss a class action lawsuit alleging it sold dietary supplements with labels featuring health claims not approved by the U.S. Food and Drug Administration.
