A class action lawsuit claiming General Mills and Kellogg lied about the health benefits of the fiber in several of their chewy nutritional bars has been tossed out by the 7th Circuit Court.

A class action lawsuit claiming General Mills and Kellogg lied about the health benefits of the fiber in several of their chewy nutritional bars has been tossed out by the 7th Circuit Court.The General Mills and Kellogg fiber bar class action lawsuit had alleged the companies did not disclose that their Fiber Plus, Fiber One and other fiber bar products contained “fake fiber.” It also said the companies did not disclose that the bar’s inferior fiber is not as healthy as natural fiber and can even cause stomach problems and even be harmful to women who are pregnant or breast-feeding. The Fiber Plus and Fiber One class action lawsuit sought damages and restitution for consumers for fraud and deceptive business practices under Illinois law.
An Illinois federal judge disagreed, however, writing that current legislation does not require companies to disclose that processed fiber offers fewer health benefits than natural fiber. And while states may ask for certain exceptions under the federal law, Illinois never obtained one to impose stricter standards.
“It’s easy to see why Congress would not want to allow states to impose disclosure requirements of their own on packaged food products, most of which are sold nationwide,” Judge Posner wrote. “Manufacturers might have to print 50 different labels, driving consumers who buy food products in more than one state crazy.”
Judge Posner said the labeling of Fiber Plus bars, Fiber One bars and other nutritional bar products challenged in the class action lawsuit is compliant with current federal regulations relating to health claims for dietary fibers.
The 7th Circuit Court affirmed Judge Posner’s decision.
The case is Turek v. General Mills, Inc. and Kellogg Co., Case No. 10-3267, U.S. Court of Appeals, 7th Circuit.

I bought six boxes of the fiber plus bars on sale and have experienced stomach pain to the point of having to miss work. Could not figure it oft till I came across this page. Ill be tossing the rest in the trash.
