A new class action lawsuit alleges Frontier Airlines discriminated against disabled and Latino passengers.
Plaintiff Arlin Socorro Molina Negron and two others filed the class action complaint against Frontier Airlines on Nov. 5 in Puerto Rico federal court, alleging violations of federal and state laws.
According to the lawsuit, Frontier Airlines has systematically discriminated against passengers, including those with disabilities, by canceling flights, denying boarding and failing to accommodate passengers with disabilities.
“Frontier’s conduct, including the arbitrary cancellation of flights, denial of boarding, hostile treatment and failure to accommodate passengers with disabilities, constitutes a pattern of discrimination, unequal treatment and denial of due process and equal protection under color of federal authority delegated to the airline industry,” the class action lawsuit says.
The plaintiffs say they were victims of discrimination and mistreatment by Frontier Airlines.
Molina Negron claims she was denied boarding and subjected to hostile treatment by Frontier employees despite complying with baggage requirements.
She says she suffered a panic attack as a result of the airline’s conduct and was forced to purchase new tickets with her personal credit card.
Frontier Airlines refused to board passengers with tickets, lawsuit alleges
Another plaintiff, Vanessa Saxton Arroyo, claims she was denied boarding on a Frontier flight due to her nationality.
She says she was told her carry-on item exceeded size limits, even though it had been accepted on a previous flight, and was denied the opportunity to pay for the item or remedy the situation.
The lawsuit alleges that another passenger in a similar situation was allowed to board without paying any additional fee, demonstrating the airline’s discriminatory intent.
The plaintiffs say they are seeking compensatory, consequential and punitive damages as well as injunctive relief requiring Frontier to implement fair, nondiscriminatory and accessible practices for all passengers.
They are looking to represent anyone who has experienced discrimination, denial of boarding or unreasonable treatment by Frontier Airlines within the past 10 years.
Earlier this year, the U.S. Department of Transportation filed a class action lawsuit against Southwest Airlines, claiming the carrier failed to adjust schedules for chronically delayed flights, causing significant harm to customers and violating federal law.
