ford class action lawsuitBack in March 2013, a multi-state class action lawsuit was filed against Ford Motor Co. alleging that between 2002 and 2010, Ford Motor vehicles contained a design defect that causes the electronic control of the gas pedals to suddenly accelerate, compromising safety. Several other Ford acceleration class action lawsuits have since been filed and are still pending in state and federal courts.

This Ford acceleration class action lawsuit was filed on behalf of numerous Ford car owners residing in 14 different states across the country. These plaintiffs are seeking Class certification for the potentially thousands of consumers who were put at risk in Ford vehicles that did not contain brake override technology, which would have reduced the risks caused by the accidental acceleration defect.

Brake override technology can stop a car if both the gas pedal and the brakes are in use at the same time. However, Ford only began installing brake override technology, known as “brake over accelerator,” in 2010 Ford vehicles, the class action lawsuit alleges.

The plaintiffs are seeking compensatory damages for the alleged loss of value the affected cars sustained because of the Ford acceleration defect. The Ford acceleration class action lawsuit is also requesting that the court order Ford to fix the defect in the affected Ford vehicle models.

Additionally, this Ford acceleration defect class action lawsuit cites a 2011 Transportation Department report performed by the inspector general, which suggests that Ford has about the same number of death and injuries due to the use of electronic throttle controls as Toyota, which has also been hit with a class action lawsuit over the alleged issue.

According to the 2011 report, between 2003 and 2009, there were a reported 374 deaths and injuries that occurred in Ford vehicles allegedly caused by the acceleration defect, and of all the unintended acceleration lawsuits filed between 2003 and 2009, 22 percent belonged to Ford alone, which, according to the inspector general, is more reports than any other major automobile manufacturer.

Ford Unintended Acceleration Defect Allegations

As previously stated, while the acceleration class action lawsuit mentioned above was filed in 2013, Ford has been hit with numerous Ford class action lawsuits since then, alleging the auto company knowingly concealed this dangerous unintended acceleration problem supposedly present in more than 30 Ford models.

The Ford vehicle models that may contain the design defect that may cause a Ford car to unintentionally and suddenly accelerate include:

Anyone who owned or leased any of the above mentioned Ford models and allegedly experienced the unintended acceleration defect may be eligible for compensation through a Ford acceleration class action lawsuit.

In general, Ford sudden acceleration lawsuits are filed individually by each plaintiff and are not class actions.
