Claiming Unum Life Insurance Company wrongfully denied his short-term and long-term disability benefits, a Florida resident filed a Unum lawsuit in the U.S District Court, Middle District of Florida, Tampa Division.
According to the Unum lawsuit, plaintiff Maximo D. became disabled as defined in his disability insurance policy and was unable to fulfill the physical demands of his position.
Maximo claims that he provided evidence of his disability but Unum Insurance has subjected him to an unreasonable claims process and wrongfully denied his coverage under the terms of his disability insurance plan.
After exhausting all his administrative appeals to the insurance provider, Maximo filed the Unum lawsuit, accusing Unum Insurance of breaching its obligations under ERISA, asking for declaratory relief, reinstatement of his unpaid disability benefits for which he is covered under his employer’s plan as well as interest, costs and attorneys’ fees.
