Flonase Class Action Settlements Get Final Approval

A federal judge has approved two class action lawsuit settlements with GlaxoSmithKline PLC over allegations the pharmaceutical giant blocked generic versions of Flonase nasal spray from entering the market. In total, GSK will pay $185 million to direct and indirect purchasers of Flonase as part of the class action settlement agreements.
On June 14, 2013, U.S. District Judge Anita B. Brody grated final approval to a $150 million settlement for direct purchasers of Flonase, which will benefit all persons or entities in the U.S. who purchased Flonase nasal spray directly from GSK at any time from May 19, 2004 until March 6, 2006.
Five days later, on June 19, Judge Brody granted final approval to a $35 million settlement with indirect purchasers of Flonase and generic Flonase. Class Members of the indirect purchaser Flonase settlement include all consumers who purchased Flonase or generic Flonase for personal, family or household consumption in the United States and its territories from May 18, 2004 through March 31, 2009. Class Members also include those who made co-payments or other partial out-of-pocket payments through their health plans.
