More pelvic mesh complaints continue to be filed against C.R. Bard, alleging that the vaginal mesh manufacturer was negligent in the device design and failed to warn patients of possible vaginal mesh complications.
According to Florida plaintiff Kim T., who recently filed a short form complaint joining the national vaginal mesh multidistrict litigation, C.R. Bard knew or should have known about the risks of problems associated with vaginal mesh, such as mesh erosion and other complications, but continued to market and promote the surgical mesh as a safe and effective treatment for pelvic organ prolapse and stress urinary incontinence.
Kim alleges that the pelvic mesh device implanted surgically in her during July 2006. The pelvic mesh device, manufactured and sold by Bard, was defective and dangerous, according to the transvaginal mesh lawsuit. The plaintiff alleges the vaginal mesh product caused her sustain serious injuries and permanent vaginal mesh complications.
Possible Vaginal Mesh Complications and Injuries
It is believed that the surgical design of Bard’s vaginal mesh products inhibits surrounding tissue from receiving nutrients and oxygen, causing impaired healing after implantation. This can lead to complications that may require further mesh surgery. Complications from vaginal mesh products are life-changing and can be irreversible. These vaginal mesh complications include:
- Mesh erosion through the vaginal tissue
- Exposure of extrusion of mesh
- Painful sexual intercourse
- Perforation or puncture of the bladder, intestines and bowels, as well as blood vessels around the vaginal wall
- Recurrent Pelvic Organ Prolapse
- Recurrent Stress Urinary Incontinence
- Urinary problems
- Vaginal bleeding
C.R. Bard Vaginal Mesh Lawsuits
Many women like Kim who experienced vaginal mesh complications are forced to undergo multiple revision surgeries in order to manage symptoms. As a result, Kim and these other plaintiffs have since filed vaginal mesh lawsuits against C.R. Bard. The medical device company now faces tens of thousands of federal lawsuits consolidated into one vaginal mesh multidistrict litigation (MDL) in the U.S. District Court for the Southern District of West Virginia before Judge Joseph R. Goodwin. Additionally, thousands more are pending in state courts across the country.
A vaginal mesh MDL allows lawsuits with similar projects alleged against a particular product to be coordinated under one judge for the purpose of avoiding duplicate discovery, inconsistent rulings, and to conserve the resources of the parties, witnesses and the court. When lawsuits are consolidated in multidistrict litigation, each case retains its own identity.
Currently, there are more than 60,000 federal vaginal mesh lawsuits against seven vaginal mesh manufacturers filed in the vaginal mesh MDL.
