A new class action lawsuit accuses Fireflies.AI Corp. of violating the Illinois Biometric Information Privacy Act by collecting and storing voiceprints without obtaining consent.
Plaintiff Ethan Fricker claims Fireflies.AI collects the voiceprints of meeting participants via its user software without providing notice, written consent or adhering to statutory safeguards required by BIPA.
Fireflies is an artificial intelligence meeting assistant that automatically joins virtual meetings conducted on platforms such as Zoom, Microsoft Teams and Google Meet.
Fricker argues Fireflies records, analyzes, transcribes and stores the voiceprints of all meeting participants, including individuals who never created Fireflies accounts, never agreed to Fireflies’ terms of service and never executed any written consent authorizing biometric data collection.
Fireflies class action claims company failed to comply with BIPA
Fricker claims Fireflies failed to inform him in writing that it was collecting his biometric data during meetings he participated in while working for Power Kiosk.
“Fireflies did not inform the plaintiff of the purpose or duration of biometric data collection,” the Fireflies class action lawsuit says. “Nor does Fireflies inform any meeting participants of the purpose or duration of biometric data collection or storage (given that Fireflies does not even inform meeting participants that it is collecting biometric data in the first place).”
Fricker wants to represent a class of individuals whose voiceprints were collected by Fireflies while they were in Illinois during the five years preceding the filing of the Fireflies class action lawsuit. He demands a jury trial and requests statutory damages, injunctive relief and other relief the court deems proper.
Last month, YouTube and Google agreed to a $6 million settlement to resolve allegations their Face Blur feature collected biometric data without proper consent in violation of the BIPA.
