Filters Fast customers may be eligible to benefit from a class action settlement resolving claims the company failed to protect their personal information during a data breach.

The class is made up of any U.S. resident whose credit or debit card was used to make a purchase on FiltersFast.com at any point between July 15, 2019, and July 10, 2020.  

Filters Fast, based in Charlotte, North Carolina, is an online retailer that sells filters for systems such as air, water, pool and spa, and refrigerators.

The company announced the cybersecurity incident in August 2020, according to the settlement website. Certain customers’ payment card information was potentially compromised during the breach.

The plaintiffs argue Filters Fast bears responsibility for the breach through negligence, breach of implied contract and other violations.

While Filters Fast denies any wrongdoing, the company has agreed to a settlement resolving these claims.

Under the terms of the settlement, Filters Fast will provide payments to class members who file a valid claim form.

Each class member’s payment will depend on their claim tier.

Tier 1 claimants are class members who attest to making a purchase using one or more payment card to make a purchase on the Filters Fast website during the class period, and who are able to provide reasonable proof of unreimbursed out-of-pocket expenses or losses caused by a fraudulent transaction on that card. Such losses could include credit-freeze fees, bank fees, certain transportation expenses and more. Tier 1 payments are capped at $750.

Tier 2 claimants are those class members who attest to making a purchase on the Filters Fast website using a payment card, who submit reasonable proof of a subsequent fraudulent charge on that card that was more likely than not caused by the data breach, and who attest the time they spent addressing this fraudulent transaction or monitoring their account as a result of the breach will be entitled to a payment for lost time at a rate of $15 per hour for up to a maximum of four hours.

Tier 3 class members attesting they used a payment card to make a purchase on the Filters Fast site during the class period will be entitled to a payment of up to $25. The total maximum amount for Tier 3 claims will be $175,000. If the claims under this tier exceed that amount, the individual payment amounts may be adjusted on a pro rata basis.

In addition to the monetary relief, class members who file a claim and who did nor previously enroll in the 12 months of ID Experts service Filters Fast offered will be eligible for 24 months of one-bureau credit monitoring. If the class member  did enroll in the service offered by Filters Fast, they will receive an additional 12 months of one-bureau monitoring.

Filters Fast also has agreed to implement enhanced security on its website, 24-hour breach and security monitoring and other security measures to make their business practice more secure.

A final fairness hearing in the Fast Filters data breach settlement will be held July 22, 2022.

The deadline for class members to opt out of or object to the settlement is June 3, 2022.

The deadline to file a claim is also June 3, 2022.
