In the aftermath of the horrific events of the Las Vegas shooting, some have called into question the responses of both the police and the Mandalay Bay hotel employees.
“What the survivors and people across this country want to see are answers,” said Brian Claypool, an attorney representing dozens of victims of the shooting and their families, and who himself survived the Oct. 1 shooting, in an Associated Press article. “How did this happen? Why did it happen? And could this have been prevented?”
News organizations were initially unable to access footage of the attack. But after suing for access, they have now obtained hundreds of videos, recordings, evidence logs, and interview reports giving insight into the response by both Mandalay Bay hotel employees, police, and emergency workers.
Experts may disagree on how the situation was handled. According to Mehmet Erdem, a hotel operations professor at the University of Nevada, Las Vegas, employees like those at Mandalay Bay hotel are trained to avoid causing their guests to panic.
“Looking at the video objectively, there’s no flags, nothing that shows any indication of negligence from the hotel management perspective,” Erdem told the Associated Press, referring to the Mandalay Bay hotel employees. “You want them to get out, but you want them to do so in an orderly manner.”
However, a retired North Las Vegas police lieutenant, Tim Bedwell, disagreed that those who responded to the attack did everything right. He said he believed that police were too slow to respond. “They should have gone directly to that room, breached that room and engaged the threat,” Bedwell said.
Many victims of the Las Vegas shooting believe that Mandalay Bay hotel and MGM Resorts should be held responsible for their part in the devastating events, and have turned to litigation after the tragedy.
Litigation Against Mandalay Bay Hotel
Just one month after the shooting, five lawsuits had already been filed in Los Angeles Superior Court, encompassing the claims of hundreds of victims.
The largest of the suits (filed against MGM Resorts International, Live Nation, and the estate of the shooter) includes 450 named plaintiffs. Lawsuits claim that MGM’s Mandalay Bay hotel and Live Nation were negligent in their actions leading up to the shooting, citing inadequate security policies, improperly trained staff, and insufficient surveillance. The shooter’s estate is being sued for assault, battery, and intentional infliction of emotional distress.
