Fila Body Toning System Class Action Lawsuit

Fila is the latest athletic apparel company to be hit with a class action lawsuit for making bogus claims that its workout gear can sculpt and tone the body.
According to the Fila class action lawsuit, Fila promises consumers that its Fila Body Toning System apparel will provide anyone who wears the apparel a variety of health benefits ordinary workout clothing cannot provide.
“For example, on each and every BTS Apparel product label, Fila promises that BTS Apparel will ‘Sculpt [and] Tone’ the body, causing a ‘50% increase in muscle workouts’ while walking, running, or just doing errands and provide ‘41% more support’ than traditional workout clothing,” states the Fila Body Toning System class action lawsuit.
“In truth, Fila’s BTS Apparel does not provide these promised benefits. There are no well-designed scientific studies that support Fila’s performance claims which, by their specificity, imply that they are well grounded in fact and scientifically supported. Fila’s representations are false, misleading, and reasonably likely to deceive the public.”
The Fila Body Toning System class action lawsuit is brought on behalf of anyone who purchased the toning apparel products in the United States. It is seeking class certification, damages, restitution and an order requiring Fila to issue a corrective advertising campaign.

I also obtained a foot injury from the Fila shoe purchased at Kohls. Been going to the doctor trying to get my foot injury correctly and still have pain and suffering to this day.
I have a pair of Fila shoes. I’ve never been able to wear them long as they are painful. Nearly New in box! Can I join the class action or is it too late?
