A new class action accuses Fandango of falsely advertising lower prices for its movie tickets, only to later disclose a mandatory convenience fee.

Plaintiff Stacy Zeid’s class action lawsuit claims Fandango’s practice of “drip pricing” is designed to sell tickets at prices higher than advertised and improperly extract additional money from consumers.

Fandango’s website does not disclose the mandatory convenience fee in the advertised price that is first displayed to consumers, Zeid claims.

“Fandango’s policy to not disclose its convenience fee upfront prevents consumers from accurately comparison shopping without investing significantly more amounts of time and effort to determine the true total cost of tickets,” the Fandango class action lawsuit claims.

Zeid wants to represent a nationwide class of consumers who paid convenience fees to purchase movie tickets at theaters in every state except New York from Fandango, along with a subclass of consumers who paid convenience fees to purchase movie tickets at theaters in Illinois.

Fandango allegedly forces consumers to invest significant time into purchasing tickets

Zeid claims Fandango’s policy and practices unfairly force consumers to invest significant time into purchasing tickets and then pay higher prices than they would normally pay to avoid wasting the time and effort they already invested in the transaction.

“Fandango advertises prices for tickets that they know are lower than the true total cost of the tickets once it adds its mandatory fee in order to make the tickets more appealing to consumers,” the Fandango class action lawsuit says.

Zeid claims Fandango is guilty of violating the Illinois Consumer Fraud Act and the New York Arts and Cultural Affairs Law. She demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and/or actual damages for herself and all class members.

Earlier this year, Fandango was sued for allegedly selling FanClub gift cards that expire 30 days after issuance, in violation of federal and California law.
