Facebook Wins Friend Finder Class Action Battle

By Mike Holter

FacebookFacebook has managed to squash another privacy class action lawsuit, this time over its use of members’ names and profile pictures to promote its Friend Finder feature.

The Facebook Friend Finder class action lawsuit, entitled Robyn Cohen v. Facebook, alleged Facebook stole users’ names and likenesses to promote its Friend Finder service, which suggests new Facebook friends to users who upload their email contacts. The case was originally thrown out June 28, but was amended and resubmitted.

The California federal judge who dismissed the case ruled the Plaintiffs offered no evidence that they had suffered economic harm due to Facebook’s use of their names and likenesses to promote Friend Finder, agreeing with Facebook’s previous argument that the Plaintiffs were not harmed, and that its privacy policy stipulates that users’ names and photos are public information.

“We appreciate the court’s consideration, and we are pleased that all claims were dismissed with prejudice,” Facebook litigation counsel Sandeep Solanki said in a statement responding to the ruling.

Facebook is currently fighting several other class action lawsuits concerning its controversial privacy practices, including one that accuses it of tracking users’ online activity even after they log off the social network.
