A new class action lawsuit alleges Fabletics Inc. misled customers into joining its automatically renewing subscription-based VIP Membership Program.
The plaintiffs filed the class action complaint against Fabletics on March 12 in California federal court, alleging violations of state and federal consumer laws.
According to the Fabletics class action lawsuit, the women’s sportswear and activewear company misleads customers into joining its automatically renewing, subscription-based VIP Membership Program by touting the value of a so-called “Promotional Member Credit.”
The plaintiffs say that in exchange for paying a $59.95 monthly membership fee, program members receive a monthly Promotional Member Credit that purports to allow a program member to purchase any single item or two-piece outfit from Fabletics for up to $100.
However, the vast majority of the individual items or two-piece outfits on offer — nearly all — do not exceed the cost of the $59.95 monthly membership fee, they allege.
“Fabletics lures customers to join a monthly recurring subscription program with the promise of a Promotional Member Credit that exceeds the $59.95 monthly membership fee, and that can be used on a variety of items of different styles and types of clothing items,” the lawsuit says.
The plaintiffs argue that based on the company’s pricing model, it would be nearly impossible for a program member to use the credit to purchase a single item or outfit exceeding $59.95, much less $100.
Fabletics automatically charges members without notice, lawsuit claims
The class action lawsuit alleges that Fabletics failed to fairly inform program members that their VIP Membership Program subscription automatically renews on a month-to-month basis.
The plaintiffs claim Fabletics automatically charges program members without providing notice or obtaining consent every month.
They seek to represent a nationwide class of consumers who purchased Fabletics’ VIP Membership Program and a subclass of Florida consumers.
The plaintiffs are suing for violations of California’s Unfair Competition Law and False Advertising Law and Florida’s Deceptive and Unfair Trade Practices Act. They seek damages, restitution, injunctive relief and reasonable attorneys’ fees and costs.
In related news, 1-800-Flowers faced a class action lawsuit in December, alleging it illegally charged customers recurring fees for its Celebrations Passport membership program without proper consent or notification.

I would like to be added as a very unhappy customer. This company is completely fraud trying to steal my money for something I did not agree to. How dare they take £59.99 out of my account without my consent!!!
I have a problem with being charged tariffs for each item I purchased eventhough they are under 25 bucks. Consumers shouldn’t have to eat that fee. Also include me on current law suit.

This is absurd, Contacted Fabletics over an attempted $69.95 charge that was denied (luckily I did not have money to cover it) wondering how the heck they have grounds to charge me for something I have only ever bought 1 item from their website , no where would I have ever agreed to be charged for 69.95 per month since I am living paycheck to paycheck, as I was looking back in my bank statements to find out when I actually bought somethign from them did i Find that they did get $69.95 last month from me unknowingly, I reached out to them and they told me that I have to cancel each month by the 5th … I said cancel what I never signed up for it.. who do i cancel this with , they said to open the chat box and cancel it there.. so as dumb as that seems .. I did it anyway, they confirmed it canceled and have since tried charging me 4 additional times in 10 days time.. .so I have to constantly keep my money moved into a savings account so they cannot get their 69.95 charge.. KEvin hart and Kate Hudson should be ashamed to have ties with them.. this is a horrible company.. thinking I had credits to spend .. might as well since they charged me before i cancelled and you cannot use the credit on anything.. its all sold out.. im pissed.. i want them to stop trying to charge me and refund me back the 69.95 they have received fraudulently.
