EyeBuyDirect class action lawsuit overview:ย

  • Why: Ramos, Henley and Ramirez argue EyeBuyDirect falsely advertises free shipping on its website, as a result of a secret so-called โ€œShipping Insuranceโ€ fee added to every order.ย

Online eyewear retailer EyeBuyDirect falsely advertises free shipping on its website, a new class action lawsuit alleges.ย 

Plaintiffs Erika Ramos, Kimberley Henley and Jessica Ramirezโ€™s class action lawsuit claims EyeBuyDirect secretly adds so-called โ€œshipping insuranceโ€ to every online order, nullifying prominent advertising for free shipping.

โ€œThe deceptive addition of the โ€˜Shipping Insuranceโ€™ renders EyeBuyDirectโ€™s promise of FREE or a flat, low-cost shipping false,โ€ the EyeBuyDirect class action says.ย 

Ramos, Henley and Ramirez want to represent a nationwide class of consumers who paid a shipping insurance fee to EyeBuyDirect within the applicable statute of limitations.ย 

EyeBuyDirect free shipping promise deceives consumers, class action claims

Ramos, Henley and Ramirez argue thousands of consumers have been assessed what amount to hidden shipping charges โ€œfrom which they did not bargainโ€ after making a purchase with EyeBuyDirect.ย 

โ€œBy unfairly obscuring its true shipping costs, EyeBuyDirect deceives consumers and gains an unfair upper hand on competitors that fairly disclose their true shipping charges,โ€ the EyeBuyDirect class action says.ย 

Ramos, Henley and Ramirez claim EyeBuyDirect is guilty of unjust enrichment and in violation of Californiaโ€™s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act, and the Washington Consumer Protection Act and Georgia Fair Business Practices Act.ย The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of statutory and monetary damages for themselves and all class members.ย 

A consumer filed a similar class action lawsuit against Williams-Sonoma Inc. earlier this year over claims the company and its subsidiary Rejuvenation Inc. falsely advertised free shipping on all items purchased on the website for Rejuvenation-brand lighting, hardware and home furnishings.ย

      I have ordered several times in the past 4 years & have had to pay an “insurance fee” each time. I still have my account & invoices.
