essure-complications-lawsuitA group of more than 30 women have filed an Essure lawsuit against Bayer alleging that the company’s permanent sterilization device, Essure, has caused them numerous health problems.

This Essure lawsuit was filed shortly after the U.S. Food and Drug Administration (FDA) announced that it was considering providing stronger warnings on the medical device.

One of the plaintiffs, Torrey B., is a resident of Pennsylvania and is currently 25 years old. She has three children and underwent the Essure procedure in August 2013.

Following her procedure, Torrey claims that she has had increasingly severe pain and discomfort as a result of the device implantation. Additionally, she has suffered from heavy menstrual bleeding, abdominal pain, severe cramping during her menstrual cycle, weight gain, abdominal bloating and fatigue.

She attributes these conditions to Essure complications, as these problems were not present prior to her Essure procedure, the claim states.

Since her procedure, Torrey states that her repeated Essure problems have caused her to continually seek treatment, including visits to the emergency room, but no treatments have been helpful to her.

After her physician ordered an ultrasound in September 2015, it was discovered that she was suffering from Essure complications, as the device had migrated out of her fallopian tubes and into her uterus, the lawsuit stated.

To treat the Essure problems, Torry had to undergo a hysterectomy at 24 years of age to have the Essure coils removed.

According to her Essure lawsuit, Torrey “is prevented from practicing and enjoying the activities of daily life she enjoyed pre-operatively, and she has otherwise suffered serious and permanent injuries.”

The plaintiffs in the Essure lawsuit have asserted a number of allegations, including multiple counts of negligence, failure to warn, manufacturing effect, common law fraud, constructive fraud, fraudulent concealment, breach of express and implied warranty, violation of consumer protection laws, violations of the Missouri Product Liability Action and Missouri Merchandising Products Act and gross negligence/punitive damages.

Torrey and the other plaintiffs in the Essure lawsuit are seeking compensatory damages with interest, cost of litigation, attorneys’ fees and other relief as deemed proper by the Court.

The compensatory damages include relief sought for “great pain and suffering and emotional distress and anguish, for severe and permanent personal injuries sustained by plaintiffs, health and medical care costs and economic and non-economic damages.”

The Essure Lawsuit is Case No. 1622-CC00690, in the Circuit Court for the City of St. Louis, Missouri.

Essure Problems Reported by Patients

A number of complications have been reported by patients who have had the Essure device implanted.

Essure consists of two small coils, and each is planted in a woman’s fallopian tube. In time, tissue grows around the coils, effectively sealing off the tube and creating a barrier to fertilization.

This is done as an in-office procedure with a physician, and women appreciate the ease of the procedure and the little downtime associated with it as compared to permanent surgical sterilization.

However, numerous problems reported have been reported, and the FDA is currently considering revising the warnings for the product.

These Essure problems include:

  • Pain in the abdomen
  • Abnormal bleeding
  • Abdominal bloating
  • Cramping
  • Device migration
  • Heavy periods
  • Vomiting
  • Back pain, arm pain or leg pain
  • Perforation of internal organs
  • Dizziness and fainting
  • Headache and migraine
  • Painful intercourse
