Essure injury claims are at the heart of a lawsuit filed by seven women in a new lawsuit against Bayer, the manufacturer.
The device at the heart of these Essure injury claims is a permanent birth control system that has been marketed as a quick and easy fix, offering irreversible results with no down time.
Two small metal and fiber coils are inserted into the fallopian tubes, which are reached through the vagina. Over the course of three months, scar tissue grows around the coils, blocking the fallopian tubes to stop the eggs’ release.
Essure Injury Claims Made by Plaintiffs
Each defendant has her own story of pain and suffering allegedly brought on by Essure.
Plaintiff Felisha D. underwent Essure implantation in June 2015. Shortly after, she says, she began experiencing severe, abnormal menstrual pain and an abnormal menstrual cycle with excessive bleeding. She suffered severe pain in her pelvis, back, and abdomen. Felisha also says she suffered an allergic reaction to the nickel in the coils.
Felisha eventually had the left side Essure device removed, and the right side was occluded through cauterization. In July 2016, she says, her Essure injuries forced her to undergo a total hysterectomy, including complete removal of both ovaries and fallopian tubes.
Plaintiff Dakarai E. underwent the Essure procedure in August 2009. She began feeling severe pelvic and abdominal pain, bloating, hair loss, back pain, fatigue, and an allergic reaction to the nickel in the coils.
In June 2014, Dakarai had a complete hysterectomy, including complete removal of both ovaries and fallopian tubes.
Plaintiff Taylor G. underwent the Essure procedure in June 2015. When she began experiencing chronic and severe pelvic pain, she reported the symptoms to her doctor. One of the Essure coils had perforated her fallopian tube. She had surgery to remove her fallopian tubes and ovaries in August 2016.
Each of the Essure injury claims resulted in the women having a more extensive surgery than the original tubal ligations that they had been trying to avoid in the first place.
After implantation of the Essure device, the women say they “began to experience one or more of the following symptoms, including, but not limited to: severe abnormal menstrual pain, abnormal menstrual cycle, excessive bleeding, severe pelvic pain, back pain, abdominal pain, pain during intercourse, headaches, allergic reaction, mood swings, migration of the device, unwanted pregnancy, and fatigue.”
According to the Essure injuries claims, Bayer failed to warn or report information regarding Essure complaints to the FDA, the public and the medical community.
“Despite the fact that evidence existed that the use of Essure was dangerous and likely to place users at serious risk to their health, defendants failed to disclose and warn of the health hazards and risks associated with Essure,” says the Essure injuries claims complaint.
Bayer stands accused of willfully distributing false and misleading information regarding the safety of Essure permanent birth control.
The Essure Injury Claims Lawsuit is Case No. 4:17-cv-03640-HSG in the Superior Court of the State of California, County of Alameda.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
